Procedures for receiving and sending documentary materials of intangible cultural heritage, artifacts, antiquities, and national treasures into museums in Vietnam

Procedures for receiving and sending documentary materials of intangible cultural heritage, artifacts, antiquities, and national treasures into museums in Vietnam (Internet image)

To be specific, in Article 7 of Circular 20/2012/TT-BVHTTDL, the regulation stipulates that the return of deposited documents and artifacts shall be executed upon the expiration of the Deposit Contract, at a location mutually agreed upon by both parties, as per the following procedures:

* The Depositor must present the following documents:

- Send Contract for documents and artifacts;

- Receipt and Delivery Minutes for documents and artifacts;

- Unexpired identity card (for Vietnamese individuals) or passport (for overseas Vietnamese and foreigners) of the person receiving the documents and artifacts;

- Notarized or certified power of attorney for receiving the deposited documents and artifacts (in case the person receiving the documents and artifacts is authorized by the Depositor who is an individual), or the document appointing a representative to receive the documents and artifacts endorsed by the legal entity of the Depositor (in case the person receiving the documents and artifacts is appointed by the organization);

- Inheritance certificate in accordance with the law (in case the individual receiving the documents and artifacts is the heir to the Depositor).

* The Depositor and the Depository shall cooperate to carry out the return of documents and artifacts following this sequence:

- Inspect the status of the returned documents and artifacts;

- Draft the Contract Liquidation Minutes for the Deposit Contract, according to Form No. 6 issued together with Circular 20/2012/TT-BVHTTDL;

- Draft the Receipt and Delivery Minutes for documents and artifacts, according to Form No. 5B issued together with Circular 20/2012/TT-BVHTTDL;

- The Depository shall hand over the documents and artifacts to the Depositor;

- The Depository shall provide the Depositor with copies of documents related to the preservation and promotion of the value of the deposited documents and artifacts formed during the deposit process.

Additionally, the maximum time to resolve the return procedure for documents and artifacts is 05 working days from the date the Depositor presents all required documents as stipulated in Clause 1, Article 7 of Circular 20/2012/TT-BVHTTDL; for cases with a large quantity of documents and artifacts, the parties shall mutually agree on the time frame. After returning the documents and artifacts, the Depository is responsible for preserving and storing related records in accordance with archival law in Vietnam.
