On July 18, 2024, the Minister of Public Security of Vietnam issued Decision 5283/QD-BCA announcing new and amended administrative procedures in the field of immigration management under the authority of the Ministry of Public Security of Vietnam.
Procedures for providing information related to the immigration of Vietnamese citizens at the provincial level from August 9, 2024 are implemented as follows:
- Implementation process:
Step 1: Prepare the dossier as prescribed by law.
Step 2: Submit the dossier
- Vietnamese citizens requesting to provide or confirm their personal information in the National Database on Immigration can directly submit or send a request to the Immigration Management Agency of the provincial police where convenient, or perform electronically at the National Public Service Portal or the Public Service Portal of the Ministry of Public Security.
For persons who have lost their civil act capacity, persons with difficulties in cognition and behavior control according to the Civil Code, and persons under 14 years old, the request form must be completed and signed by their legal representative.
- Immigration management officers receive the dossier and check the legality and content of the dossier:
+ If the dossier is complete and valid, an appointment slip will be issued, or the system of the Public Service Portal will notify via text message (SMS) or email about the receipt of the dossier.
+ If the dossier is incomplete or invalid, the receiving officer will guide or the Public Service Portal system will notify via text message (SMS) or email for the applicant to complete the dossier as prescribed.
+ If the dossier does not meet the conditions, it will not be accepted, and a written response or a notification on the Public Service Portal will be provided stating the reason.
- Dossier receipt time: from Monday to Saturday morning every week (except Tet holidays and public holidays).
Step 3: Receive the result
+ The applicant directly receives the response document at the Immigration Management Agency of the provincial police where the dossier was submitted, or via postal service, or through the Public Service Portal system.
+ Result receipt time: From Monday to Friday every week (except Tet holidays and public holidays).
- Execution method:
+ Directly: submit the dossier directly at the headquarters of the Immigration Management Agency of the provincial police.
+ Online: submit the dossier online through the National Public Service Portal or the Public Service Portal of the Ministry of Public Security.
+ Postal service: send the dossier via public postal service to the Immigration Management Agency of the provincial police.
- Components and quantity of the dossier:
+ Request form for confirmation, and provision of information (Form M03a) issued together with Decree 67/2024/ND-CP dated June 25, 2024 of the Government of Vietnam.
+ For persons who have lost their civil act capacity, persons with difficulties in cognition and behavior control, and persons under 14 years old, the request form must be completed and signed by their legal representative, accompanied by a copy of documents issued by competent authorities of Vietnam proving the legal representative; if there is no copy, the original must be presented for verification and comparison.
+ Dossier quantity: 01 (one) set.
- Processing time: 05 working days from the date of receipt of the citizen's request.
- Subjects of administrative procedure implementation: Vietnamese citizens
- Agency implementing administrative procedures: Immigration Management Agency of the provincial police.
- Result of administrative procedure implementation: written response from the Immigration Management Agency of the provincial police.
- Fees and charges: none.
- Name of form, declaration form: Request form for confirmation, and provision of information (Form M03a) issued together with Decree 67/2024/ND-CP dated June 25, 2024 of the Government of Vietnam.
- Requirements, conditions for implementing administrative procedures: Vietnamese citizens requesting to provide or confirm their personal information in the National Database on Immigration to ensure the protection of their lawful rights and interests.
