Regarding this issue, LawNet would like to answer as follows:

Procedures for issuing international travel business licenses in Vietnam

(1) Implementation order:

- Enterprises applying for international travel business licenses submit their applications to the Vietnam National Tourism Administration;

- Within 10 days from the date of receipt of valid documents, the Vietnam National Tourism Administration appraises and issues international travel business licenses to businesses and notifies the Department of Tourism/Department of Culture, Sports, and Tourism where the business is headquartered; In case of refusal, it must be notified in writing and clearly state the reason.

(2) Submission method: Send directly or online through the Public Service Portal of the Ministry of Culture, Sports and Tourism or by mail to the Vietnam National Tourism Administration.

(3) Components and quantity of documents:

- Document components:

+ Application for international travel business licenses (according to Form No. 04, Appendix II issued with Circular 06/2017/TT-BVHTTDL);

+ Certified copy of Business Registration Certificate or Investment Registration Certificate issued by a competent state agency;

+ Certificate of deposit for international travel services business;

+ A certified copy of a college diploma or higher with a major in travel of the person in charge of the travel service business; or a certified copy of a college diploma or higher in another major and a certified copy of an international tourism operations certificate. Diplomas issued by foreign training institutions must be recognized according to the regulations of the Ministry of Education and Training and the Ministry of Labor, War Invalids, and Social Affairs;

+ A certified copy of the appointment decision or labor contract between the travel service business and the person in charge of the travel service business.

- Number of documents: 01 (set).

(4) Processing time: 10 days from the date of receipt of valid documents.

(5) Subjects performing administrative procedures: organizations.

(6) Agencies implementing administrative procedures:

- Deciding authority: Vietnam National Tourism Administration

- Agency directly implementing administrative procedures: Travel Management Department, Vietnam National Tourism Administration

(7) Results of implementing administrative procedures: international travel business licenses.

(8) Fees and charges: 3,000,000 VND/license (according to Circular 33/2018/TT-BTC).

(9) Name of application form, declaration form: Application for issuance of international travel business licenses (according to Form No. 04 Appendix II issued with Circular 06/2017/TT-BVHTTDL).

(10) Requirements and conditions for implementing administrative procedures:

- An enterprise established according to the provisions of the law on enterprises;

- Deposit for international travel services business at commercial banks, cooperative banks, or foreign bank branches established and operating in Vietnam:

+ Travel service business for international tourists coming to Vietnam: 250,000,000 VND (Two hundred and fifty million VND);

+ Travel service business for tourists going abroad: 500,000,000 VND (Five hundred million VND);

+ Travel service business for international tourists coming to Vietnam and tourists going abroad: 500,000,000 VND (Five hundred million VND).

- The person in charge of travel service business must have graduated from college or higher with a major in travel; If you graduate from college or higher in another major, you must have a professional certificate in international tourism operations.

+ The person in charge of travel service business is the person holding one of the following positions: chairman of the board of directors; chairman of the board of members; company president; private business owners; general manager; director or deputy director; head of travel services business.

+ Travel major is shown on the diploma of one of the following fields, occupations, or majors:

++ Tourism and travel service management;

++ Travel management;

++ Tour operator;

++ Tourism marketing;

++ Travel;

++ Travel and tourism;

++ Tourism business and management;

++ MICE tourism management;

++ Travel agency;

++ Travel guide;

++ Occupation, profession, or major that represents one of the phrases “du lịch” (tourism), “lữ hành” (travel), “hướng dẫn du lịch” (travel guide) trained and awarded diplomas by educational institutions in Vietnam
  before February 1, 2018);

++ Occupation, profession, or specialty that represents one of the phrases “du lịch” (tourism), “lữ hành” (travel), “hướng dẫn du lịch” (travel guide) trained and awarded a diploma by a foreign training institution.

In case the diploma does not show the majors, occupations, or majors specified above, add a graduation transcript or diploma appendix showing the majors, occupations, majors, and majors including one of the phrases  “du lịch” (tourism), “lữ hành” (travel), “hướng dẫn du lịch” (travel guide).
