On May 20, 2024, the Ministry of Foreign Affairs issued Decision 1275/QD-BNG on the announcement of amended administrative procedures related to consular under the management of the Ministry of Foreign Affairs of Vietnam.
(1) Implementation process:
Step 1: Organizations and individuals prepare documents according to regulations and submit them to the receiving department.
The receiving department includes:
- Single-Window Department of the Ministry of Foreign Affairs at 40 Tran Phu, Ba Dinh, Hanoi;
- Ho Chi Minh City Department of Foreign Affairs, 6 Alexandre De Rhodes, District 1, Ho Chi Minh City.
Step 2: The receiving department checks the validity and completeness of the documents:
- In case the documents are not within the scope of settlement, the receiving department guides the organization or individual to contact the competent authority for settlement according to regulations.
- In case the documents are incomplete or invalid, the receiving department guides the organization or individual to supplement and complete the documents according to regulations and returns the documents along with a "Request for Supplementing and Completing Documents" form. The request for supplementing and completing the documents must be specific and complete at once for the organization or individual to supplement fully and accurately. The deadline for settling administrative procedures is counted from the date when the documents are fully supplemented and completed according to regulations.
- In case the documents do not meet the conditions for settlement according to regulations, the receiving department refuses to accept the documents and returns them along with a "Refusal to Accept Documents for Settlement" form to the organization or individual.
- In case the documents are valid and meet the conditions for settlement, the receiving department proceeds to receive them, requests a "Receipt of Documents and Appointment for Result" form, and transfers the documents to the specialized unit for settlement according to its jurisdiction.
Step 3: The specialized unit settles the documents and returns the results to the receiving department according to regulations:
- In case the documents need to be supplemented or completed according to regulations, the specialized unit must notify in writing, stating the reasons and content that need to be supplemented according to the "Request for Supplementing and Completing Documents" form to be sent to the organization or individual through the receiving department. The request for supplementing and completing the documents can only be made once. The deadline for settling administrative procedures is recalculated from the beginning after receiving the fully supplemented documents.
- In case it is not possible to provide the results on time or the documents need the opinion of the relevant authority, the specialized unit must notify the receiving department in writing and send an apology letter to the organization or individual, clearly stating the reasons for the delay and the time for returning the results according to the "Apology Letter and Appointment for Result" form. The appointment for returning the results can only be made once.
- In case the documents do not meet the conditions for settlement, the specialized unit returns the documents along with a letter stating the reasons for not settling the documents according to the "Refusal to Accept Documents for Settlement" form to be sent to the organization or individual through the receiving department.
- In case the documents meet the conditions for settlement, the specialized unit settles the documents and returns the results to the receiving department within the specified time.
Step 4: After receiving the results of the settlement of administrative procedures from the specialized unit, the receiving department checks the information again and returns the results to the organization or individual. In case the documents do not meet the conditions for settlement, the receiving department explains clearly to the organization or individual the reasons for refusing to settle the documents according to the content in the "Refusal to Accept Documents for Settlement" form from the specialized unit.
(2) Submission methods:
- Directly submit documents and receive results at the receiving department.
- Local consular offices directly or through public postal services to transfer the documents along with the fees and receive the results at the domestic passport issuing agency. Local consular offices use public postal services according to the instructions of the Ministry of Foreign Affairs.
- Through electronic environment in case the technical infrastructure at the domestic passport issuing agency of the Ministry of Foreign Affairs allows (including...).
