On January 25, 2024, the Ministry of Transport issued Decision 77/QD-BGTVT announcing amended registration-related administrative procedures under the Ministry of Transport.

Procedures for issuing design appraisal certificates for automobiles in Vietnam under Decree 116/2017

(1) Procedures:

* Submitting application:

- Design establishments shall prepare automobile design documents according to regulations and submit them to the Vietnam Register.

* Processing application:

- The Vietnam Register shall receive and verify the components of the design documents. If the documents are incomplete according to regulations, the Vietnam Register will return the documents on the same working day for direct submissions or within 2 working days from the date of receiving the documents for other submission methods. They will also provide guidance for the design establishments on how to complete the documents. If the documents are complete, the Vietnam Register will accept them and proceed with the design appraisal.

- The Vietnam Register shall check the content of the automobile design documents against the current technical standards and regulations on technical safety and environmental protection for automobiles within 10 working days from the date of receiving the complete documents. Within 3 working days from the date of the design appraisal results, if the design documents meet the requirements, the Vietnam Register will issue the design appraisal certificate.

If the automobile design documents are complete but some content does not meet the requirements, the Vietnam Register will notify the design establishment through written communication or through the online public service system, stating the reasons and content that do not meet the requirements for the design establishment to complete the design documents. The design establishment is responsible for completing the design documents and re-submitting them within 30 working days from the date of notification to the Vietnam Register. Within 10 working days from the date of receiving the complete and amended documents, the Vietnam Register shall compare the content of the design documents with the technical standards and regulations on technical safety and environmental protection for automobiles. Within 3 working days from the date of the design appraisal results, if the design documents meet the requirements, the Vietnam Register will issue the design appraisal certificate. If the design documents do not meet the requirements, the Vietnam Register will notify the design establishment through written communication or through the online public service system, stating the reasons for not issuing the design appraisal certificate. If the design establishment does not complete the incomplete content of the design documents within 30 working days from the date of notification, the Vietnam Register will suspend the design appraisal process and notify the design establishment through written communication or through the online public service system that the design appraisal certificate will not be issued. To continue the design appraisal process for automobiles, the design establishment must resubmit the documents from the beginning.

- The design establishment shall receive the design appraisal results, including the design appraisal certificate, 01 technical design description, and technical drawings of the design documents that have been appraised (02 copies for design establishments that are different from the production establishments), directly at the headquarters of the Vietnam Register or through postal services or other appropriate methods.

(2) Implementation method:

- Submitting directly, through postal services, or through the online public service system.

(3) Components and quantity of documents:

* Components of the documents:

** Appraisal of new design documents:

- Application form for the design appraisal of automobiles according to regulations.

- Technical design description and technical drawings according to regulations.

- Copies of specifications and technical features of components and related systems related to design calculations.

** Re-appraisal of design documents (when there are changes, additions, or amendments to the design documents compared to the appraised design documents, but still meet the requirements for products of the same type as specified in Appendix I issued together with Circular 25/2019/TT-BGTVT, when there are changes to the standards and technical regulations, except for cases where the Certificate of Technical Safety and Environmental Protection for the product type is still valid)

- Application for design appraisal of automobiles according to regulations.

- Technical design description and technical drawings according to regulations (related to the changed content).

- Copies of specifications and technical features of components and related systems related to design calculations (related to the changed content).

* Quantity of documents:

- In case of submitting documents through the online public service system: submit 01 set of electronic design documents.

- In case of submitting documents directly or through postal services: in addition to submitting 01 set of design documents, the design establishment will also submit 01 technical design description and technical drawings (02 copies if the design establishment is different from the production establishment).

(4) Processing time:

- Time for comparing the content of the automobile design documents with the current technical standards, regulations, and requirements: within 10 working days from the date of receiving the complete documents.

- Time for issuing the design appraisal certificate: within 3 working days from the date of the design appraisal results, if the design documents meet the requirements.

(5) Subjects implementing the administrative procedure: Organizations.

(6) Administrative agency implementing the procedure:

- Competent authority: Vietnam Register;

- Authorized agency or person: None;

- Direct administrative agency: Vietnam Register;

- Coordinating agency: None.

(7) Results of the administrative procedure:

- Design appraisal certificate, technical design description, and technical drawings of the appraised design documents.

- Notification in writing or through the online public service system stating the reason for not issuing the design appraisal certificate.

(8) Fees and charges:

- Charges for issuing the certificate: for automobiles with less than 10 seats (excluding ambulances), the fee is 90,000 VND/1 certificate; for other types of automobiles, the fee is 40,000 VND/1 certificate.

- Design appraisal fee: calculated at 8% of the design price declared by the design establishment, but not less than 2,000,000 VND/1 design; in cases of additional or modified design documents that have been appraised, the design appraisal fee is 1,000,000 VND/1 design. When merging designs of products of the same type, the design appraisal fee is the total of the additional fees.
