On January 25, 2024, the Ministry of Transport issued Decision 77/QD-BGTVT announcing amended registration-related-administrative procedures under the Ministry of Transport.

Procedures for issuing Certificate of design evaluation for manufactured, assembled motor vehicles in Vietnam

(1) Procedure:

* Submit administrative procedure documents:

- If the design facility or manufacturing facility is qualified to design the product itself (hereinafter referred to as the design facility), the applicant prepares an application requesting a design appraisal according to regulations and submits it to the Vietnam Register.

* Resolve administrative procedures:

- Vietnam Register receives and checks the composition of the dossier: if the dossier is not complete according to regulations, it will instruct the establishment to complete it again; If the dossier is completed as prescribed, write a letter to schedule a time to return the design appraisal results.

- Appraisal of design content is carried out within 08 working days from the date of receipt of complete documents as prescribed. In case the design dossier has satisfactory appraisal results (satisfactory design dossier), the Vietnam Register shall issue a Certificate of design appraisal within 03 working days from the date of satisfactory design dossier appraisal results.

+ In the event that the design documents are complete but have contents that do not meet the requirements, the Vietnam Register shall notify in writing or through the online public service system of the reasons and contents that do not meet the requirements so that the Design Facility can complete the design documents. The design facility is responsible for completing the design documents, submitting them within 30 working days from the date of notification, and sending them back to the Vietnam Register. Within 08 working days from the date of receiving the fully completed dossier, the Vietnam Register will check and re-evaluate the design dossier. If the design documents meet the requirements, the Vietnam Register will issue a Certificate of design appraisal; If the design dossier does not meet the requirements, the Vietnam Register shall notify in writing or via the online public service system of not issuing the Certificate of design appraisal and clearly state the reason.

+ After 30 working days from the date of notification, if the design facility fails to complete inappropriate contents of the design documents, the Vietnam Register will stop the appraisal of the design documents and notify in writing or on the online public service system of not issuing the Certificate of design appraisal. To continue evaluating design documents, the design facility must resubmit the documents from the beginning;

- The design facility that receives design appraisal results includes:

+ In case of receiving directly at the headquarters of the Vietnam Register or through the postal system: 01 Certificate of design appraisal; technical design explanation and technical drawings (01 copy in case the design facility is also a production facility or 02 copies in case the design facility is different from the production facility) of design documents.

+ In case of receiving through the online public service system: an electronic copy of Certificate of design appraisal; an electronic version of the technical design explanation; and technical drawings of design documents.

(2) Submission methods:

- Submit application for design appraisal and receive results directly at the headquarters of the Vietnam Register, through the postal system, or through the online public service system.

(3) Components and quantity of documents:

* Components:

- 01 original or electronic form of request for design appraisal;

- 01 design file:

+ Explanation of motor vehicle technical design (Original copy in case of direct submission or via postal system; or electronic copy in case of submission via online public service system) ;

+ Technical drawing (Original copy in case of direct submission or via postal system; or electronic copy in case of submission via online public service system);

+ Specifications and technical features of components and systems related to design calculation content (Authenticated copy of the design basis in case of submitting documents directly or via the postal system; or electronic copy in case of submitting documents via the online public service system).

(In case of direct submission or by post: in addition to submitting 01 set of design documents as prescribed, submit 01 additional set of documents (Explanation of motor vehicle technical design and Technical drawings) or 02 sets in case the design facility is different from the production facility).

* Number of documents: 01 set.

(4) Processing time limit:

- Appraisal of design content is carried out within 08 working days from the date of receipt of complete documents, according to regulations.

- Issuance of Certificate of design appraisal shall be within 03 working days from the date of satisfactory design dossier appraisal results.

(5) Subjects performing administrative procedures: Organizations.

(6) Agencies implementing administrative procedures:

- Authority with decision-making authority: Vietnam Register;

- Authority or competent person authorized or decentralized to implement: None;

- Agency directly implementing administrative procedures: Vietnam Register;

- Coordinating agency: None.

(7) Results of implementing administrative procedures:

- Certificate of design appraisal; technical design explanation; and technical drawings.

- Notify via the online public service system about not issuing the Certificate of design appraisal and clearly state the reason.

3.8. Fees, Charges and Prices:

- Design appraisal price: calculated by 8% of the design price announced and declared by the design facility but not lower than 2,000,000 VND/1 design; In case of supplementing or modifying design documents that have been appraised, the design appraisal price is 1,000,000 VND/1 design. When combining designs of products of the same type, the design appraisal price is the sum of the additional prices.

- Issuance fees: for vehicles with less than 10 seats (excluding ambulances), it is 90,000 VND/01 certificate; for other types of vehicles, it is 40,000 VND/1 certificate.
