On October 4, 2024, the Minister of Construction issued Decision No. 907/QD-BXD regarding the announcement of new administrative procedures, replacing those in the field of real estate business under the scope of State management.

Procedures for issuance of new practicing certificates for real estate brokers in Vietnam (Latest)

(1) Implementation Steps:

- Before each exam session, candidates directly submit 01 set of registration documents for the exam complying with the provisions of Article 26 and the exam fee as prescribed at point a, clause 5, Article 19 of Decree 96/2024/ND-CP. The time and place for submission of the documents are as announced by the provincial People's Committee.

- Based on the Decision approving the list of individuals granted certificates, the examination organizing unit is responsible for sending photocopies of the exams and dossiers of those individuals to the provincial People's Committee for certificate issuance.

- The Chairperson of the Examination Council reports to the Chairperson of the provincial People's Committee on the exam organization process and approves the exam results.

- Based on the report of the Examination Council Chairperson and the exam results approved by the Chairperson of the Examination Council, the Chairperson of the provincial People’s Committee approves the list of individuals to be granted certificates (according to the template in Appendix XXII of Decree 96/2024/ND-CP). Within 10 working days from the date of receiving all valid documents, the provincial People's Committee organizes the printing and issuing of certificates.

- The provincial People's Committee is responsible for keeping the files of the certified individuals for a period of 10 years from the date of issuance.

(2) Method of Implementation: Direct submission, postal service, or online.

(3) Component Documentation, Number of Documents:

* Component Documentation:

- 01 Exam registration form with a 4x6cm sample photo taken within 6 months up to the exam registration date (according to the template in Appendix XXI of Decree 96/2024/ND-CP dated July 24, 2024, of the Government of Vietnam detailing some articles of the Law on Real Estate Business).

- 01 Certified copy of the ID card or Citizen ID or Identity card according to the legal provisions on identification; documents proving Vietnamese nationality or confirmation as a person of Vietnamese descent under nationality law or a passport (or a copy with the original for comparison).

- 01 Certified copy of the Certificate of Completion of the training course on real estate brokerage practice knowledge.

- Certified copy of high school diploma or higher (or equivalent).

- 02 Color photos, size 4x6cm, taken within 6 months up to the exam registration date, 02 stamped envelopes stating full name, phone number, and address of the recipient.

- Certified copy and translation of the foreign-issued certificate (for foreigners and Vietnamese with a valid foreign-issued practicing certificate for real estate brokers).

* Number of Documents: 01 set

(4) Processing Time: Within 10 days from the announcement of the examination results.

(5) Subjects for Administrative Procedures: Individuals seeking certificate issuance.

(6) Administrative Procedures Executing Agency: Provincial People's Committee

(7) Results of Administrative Procedures: practicing certificate for real estate brokers.

(8) Fees: According to the legal provisions on fees and charges

(9) Name of Form, Declaration Form:

- Exam registration form according to the template in Appendix XXI issued with Decree 96/2024/ND-CP dated July 24, 2024, of the Government of Vietnam detailing some articles of the Law on Real Estate Business.

(10) Requirements and Conditions for Administrative Procedures:

Individuals taking the proficiency exam with a passing score (Foundation knowledge section of 70 points or more (out of 100), and Professional knowledge section of 70 points or more (out of 100)) and have sufficient documentation as stipulated above shall be issued a certificate.
