On August 1, 2024, the People's Committee of Hanoi City issued Decision 51/2024/QD-UBND regarding the Working Regulation of the People's Committee of Hanoi City.

Procedures for Hanoi People's Committee meetings under latest regulations in Vietnam

According to Article 29 of the Regulation issued with Decision 51/2024/QD-UBND, the procedures for the meetings of the People's Committee of Hanoi City are specified as follows:

- The Chief of Office of the City People's Committee reports the content, program, and list of participants of the meeting.

- The Chairman of the City People's Committee presides over the meeting.

- The City People's Committee discusses each item in the program:

+ Heads of provincial departments and authorities, the project-proposing bodies present a summary of the project and the issues needing inputs from the City People's Committee. The presentation should not exceed 10 minutes. In special cases with the chairman's permission, the presentation time may be extended.

+ The Chief of Office of the City People's Committee presents a aggregated report of the opinions of the committee members (if any), highlighting the individual views of each member, the consensus reached, unresolved issues, and recommendations for the City People's Committee to discuss and approve; a review report from the Office of the City People's Committee.

+ The Chairman or Vice Chairman of the City People's Committee leads the discussion and voting.

+ Members of the City People's Committee express their opinions, stating their approval or disapproval of each item without commenting on issues already agreed upon within the scope of the project. Each speech should not exceed 7 minutes.

+ The Chairman of the City People's Committee concludes, and the members vote. If any issues remain unclear, the chairman may request members to delay voting and ask the project proposer to provide further clarifications.

- For clear issues with no differing opinions among provincial departments and authorities and the decision-making authority of the City People's Committee, with the Chairman's agreement, the Chief of Office presents a consolidated report of the issues for the City People's Committee to consider and approve.

- If necessary, the Chairman may request members of the committee or heads of provincial departments and authorities, and other bodies to report on related issues outside the meeting agenda.

- Voting at the City People's Committee meeting:

+ The committee decides on issues through voting. Members have the right to vote for, against, or abstain.

+ The committee decides to use one of the following voting methods: Open voting or secret ballot at the meeting; written opinions on a feedback form; online voting through the city's electronic information system.

- Voting by written opinions:

+ For urgent issues or those not requiring a meeting discussion and vote, the Chairman decides on voting by written opinion forms.

+ The Office of the City People's Committee must announce the result of the voting by written opinion forms at the next committee meeting.

- For draft legal documents included in the meeting agenda, aside from complying with the provisions of Article 29 of the Regulation issued with Decision 51/2024/QD-UBND, the meeting procedure follows the provisions of the Law on Promulgation of Legal Documents.

More details can be found in Decision 51/2024/QD-UBND which comes into force in Vietnam from August 11, 2024, replacing Decision 51/2024/QD-UBND regarding the issuance of the Working Regulation of the Hanoi City People's Committee. Agencies under the City People's Committee, People's Committees of districts, towns issue working regulations in accordance with the Regulation issued with Decision 51/2024/QD-UBND.
