From January 1, 2025, the procedures for handling frequent road traffic accident spots, potential road traffic accident spots in Vietnam will be implemented in accordance with the guidelines in Circular 41/2024/TT-BGTVT.

On November 15, 2024, the Minister of Transport of Vietnam issued Circular 41/2024/TT-BGTVT providing regulations on management, operation, exploitation, maintenance, and protection of road infrastructure.
Article 15 of Circular 41/2024/TT-BGTVT stipulates the procedures for handling frequent road traffic accident spots, potential road traffic accident spots in Vietnam from January 1, 2025 as follows:
(1) The road management agency, road managers, and users are responsible for compiling information according to the following criteria: number of traffic accidents, number of deaths, and number of injuries due to traffic accidents; damage to infrastructure, vehicles involved in traffic; annual road traffic order and safety status; receiving, checking, and processing information from traffic police forces on the route, organizations, individuals (if any) regarding traffic conditions on the roadway; organizing inspection, evaluation of the scene, and comparing with provisions in Article 14 of Circular 41/2024/TT-BGTVT to prepare profiles for handling frequent road traffic accident spots, potential road traffic accident spots.
(2) Road managers and users perform the following tasks to address frequent road traffic accident spots, potential road traffic accident spots:
(i) Inspect the scene, compare, supplement characteristics of the scene: traffic situation at intersections; traffic organization plans; check technical factors of road infrastructure such as visibility, radius of horizontal curves, vertical curves, slope, roughness index, pavement texture, superelevation, other technical factors; road safety corridor; sketch diagrams, take photographs of the scene; assess, determine traffic flow, vehicle components, traffic conditions, and pedestrians; weather, climate conditions, and surrounding environmental factors affecting traffic safety, and other necessary information;
(ii) Based on the scene profile collected, construct a base map showing the main features of the scene: segment where accident occurs, road signs, and markings, traffic safety structures, terrain on both sides of the road to analyze, evaluate the situation, identify traffic accident causes;
(iii) Based on results from (i) and (ii), the road manager, user proposes solutions to resolve locations prone to traffic accidents and latent traffic accident spots, including determining the roadmap, completion time of the resolution.
(3) Handling locations prone to road traffic accidents:
- For locations prone to accidents on national highways as specified in clause 3, Article 8 of the Road Law but not included in the approved management, operation, exploitation, and maintenance plan, the Vietnam Road Administration is authorized to permit investment preparation (or technical-economic report) and promptly organize implementation to ensure road traffic safety; update and submit to the Ministry of Transport for approval to adjust management, operation, exploitation, and maintenance plans;
- People's Committees at all levels decide and organize the implementation of handling locations prone to road traffic accidents on roads within their management scope;
- Enterprises assigned by the state to manage, exploit, and use the road according to the provision at point d, clause 2, Article 9 of Circular 41/2024/TT-BGTVT have the responsibility to promptly handle locations prone to traffic accidents ensuring road traffic safety.
(4) For latent traffic accident spots outside the approved management, operation, exploitation, maintenance plan, the road management agency, managers, users propose that the authorized agency approve a management, operation, exploitation, and maintenance plan allowing for emergency repair project investment preparation, excluding provisions at point b and point c, clause 4, Article 9 of Circular 41/2024/TT-BGTVT for national highways managed by the Ministry of Transport to rectify latent traffic accident spots.
(5) The road management agency, managers, and users shall notify the results of handling frequent road traffic accident spots, potential road traffic accident spots to the organizations, individuals who raised suggestions.
