On January 19, 2024, the Ministry of Transport issued Decision 62/QD-BGTVT announcing amended and supplemented administrative procedures in the field of registration within the scope of management functions of the Ministry of Transport.

Procedures for granting design appraisal certificate for modified motor vehicles in Vietnam

(1) Implementation order:

* Submit administrative procedure documents:

- The design facility submits the application for design appraisal to the Vietnam Register or the Department of Transport (design appraisal agency).

* Resolving administrative procedures:

- The design appraisal agency receives and checks the dossier components: if the dossier is not complete according to regulations, it will instruct organizations and individuals to supplement and complete it within the same working day.
(in case of direct application and via the online public service system) or notification and instructions to complete the application within 02 working days (in case of submission via the postal system); In case the dossier is complete, the design appraisal agency will issue a dossier receipt slip (original in case of direct submission, via postal system, or electronic copy for the online public service system).

- The design appraisal agency conducts design appraisals according to regulations. If the design meets the requirements, after 05 working days from the date of receiving complete design documents, the design appraisal agency issues a design appraisal certificate. In case of refusal, the design appraisal agency shall notify the design facility in writing and clearly state the reason for the refusal after 02 working days from the date of the appraisal results;

- In case the design dossier components are complete but have content that needs to be amended or supplemented, the design appraisal agency shall notify the Design Facility to supplement or amend the design dossier. The design facility is responsible for supplementing and completing the design documents and submitting them within 30 days from the date of notification. Within 5 working days from the date of receipt of the amended and supplemented dossier, if the design dossier meets the requirements, the design appraisal agency will issue a Design Certificate; If the dossier does not meet the requirements, the design appraisal agency will notify the motor vehicle design dossier of failure. After 30 days from the date of notification, if the Design Facility does not make modifications or additions, the Design Appraisal Agency will issue a Notification of unsatisfactory motor vehicle design documents;

- The design appraisal agency must record in the Control Sheet the entire design appraisal process according to regulations;

- Design establishments can submit applications and receive results directly at the design appraisal agency's headquarters, through the postal system, or through the online public service system;

- Approved design documents and design appraisal certificate (original) are kept at the design appraisal agency, 01 set, and the acceptance agency 01 set; approved design documents (copy certified by the design unit) and design appraisal certificate (original) are kept at the design facility 01 set and the construction facility 01 set in case of submitting documents and returning results directly or through the postal system.

(2) Submission method

- Submit directly at the design appraisal agency's headquarters, through the postal system, or through the online public service system.

(3) Components and quantity of documents:

* Profile components:

- Written request for design appraisal according to the form (original copy or electronic form in case of submitting documents via the online public service system);

- Design documents (02 sets in case of submitting documents directly at the design appraisal agency headquarters or via the postal system; or 01 electronic dossier in case of submitting documents through the online public service system); the renovated motor vehicle design dossier includes:

+ Explanation of motor vehicle technical design according to regulations (original copy in case of direct submission or submission via postal system; or electronic document in case of submission via online public service system);

+ Technical drawings as prescribed (original copy in case of direct submission or submission via postal system; or electronic document in case of submission via online public service system).

- Documentation of parameters and technical features of renovated motor vehicles, components, and systems of renovation and replacement
(Copy certified by the design unit or electronic copy in case of submitting documents via the online public service system);

- One of the following documents: Car Registration Certificate; Name Transfer and relocation slip (for cases where name transfer or relocation procedures are in progress); Certificate of technical safety and environmental protection quality for imported motor vehicles or documents certifying the completion of import procedures (for used motor vehicles that are allowed to be imported without registration plates) (Copy certified by the design unit or electronic copy in case of submitting documents via the online public service system).

* Number of documents: 01 set.

(4) Processing time limit:

- In case the design meets the requirements: after 05 working days from the date of receiving complete design documents, the design appraisal agency will issue a design appraisal certificate. In case of refusal, the design appraisal agency shall notify the design facility in writing and clearly state the reason for the refusal after 02 working days from the date of the appraisal results.

- In case the design dossier components are complete but have content that needs to be modified or supplemented: Within 5 working days from the date of receipt of the amended and supplemented dossier, if the design dossier meets the requirements, the design appraisal agency will issue a Design Certificate; If the dossier does not meet the requirements, the design appraisal agency will notify the motor vehicle design dossier of failure.

(5) Subjects performing administrative procedures: organizations and individuals.

(6) Agencies implementing administrative procedures:

- Authority with decision-making authority: Vietnam Register; Transportation facilities;

- Authority or competent person authorized or decentralized to implement: None;

- Agency directly implementing administrative procedures: Vietnam Register; Transportation facilities;

- Coordinating agency: None.

(7) Results of implementing administrative procedures:

- Design appraisal certificate for modified motor vehicles.

(8) Fees, charges, and prices:

- Fee for issuing a design appraisal certificate for modified motor vehicles 40,000 VND/ 01 Certificate (only for cars with less than 10 seats: 90,000 VND/ 01 Certificate);

- Price for design appraisal of motor vehicles and specialized motorcycles for renovation: 300,000 VND/unit.
