Procedures for granting certificate of registration of non-commercial general aviation activities in Vietnam (Internet image)

On February 19, 2024, the Ministry of Transport issued Decision 162a/QD-BGTVT on announcing revised administrative procedures in the aviation sector within the scope of management functions of the Ministry of Transport.

Procedures for granting certificate of registration of non-commercial general aviation activities in Vietnam

(1) Procedure:

* Submit administrative procedures:

Organizations and individuals applying for a certificate of registration of non-commercial general aviation activities must send documents directly or via the postal system or other appropriate forms to the Civil Aviation Authority of Vietnam.

* Handling administrative procedures:

- Within 25 working days from the date of receipt of complete documents as prescribed, the Vietnam Aviation Administration appraises the dossier and sends a document to seek opinions from the Department of Operations (Ministry of National Defense) on organizations and individuals registering for general aviation activities, aircraft types, and flight areas or notify the applicant of refusal to issue a Certificate and clearly state the reason;

- Department of Operations (Ministry of National Defense) is responsible for responding to the Vietnam Aviation Administration within 10 working days from the date of receipt of the written request. The Vietnam Aviation Administration issues a Certificate according to the form after receiving approval from the Department of Operations (Ministry of National Defense) or notifying the applicant of refusal to issue a Certificate and clearly stating the reason.

(2) Submission:

- Submit application directly; or

- Submit application via postal system; or

- Other suitable forms.

(3) Components and quantity of documents:

* Components:

- An application form, which is made using the Form No. 06 or the Form No. 10 (in case of applying for re-issuance of the certificate);

- Copies from the master register or copies presented together with their originals for comparison or certified true copies (if the application is submitted in person); certified true copies (if the application is submitted by post) of the following documents:

+ Establishment license or operation license or enterprise registration certificate (if the applicant is an organization);

+ ID card, Citizen ID card or passport (if the applicant is an individual);

- Copies from the master register or copies presented together with their originals for comparison or certified true copies (if the application is submitted in person); certified true copies (if the application is submitted by post) of the following documents:

+ Vietnam Permanent Residence Card (for the foreign citizen permanently residing in Vietnam);

+ License for establishment of representative office or branch in Vietnam (for the representative office or branch of a foreign organization);

- Copies from the master register or copies presented together with their originals for comparison or certified true copies (if the application is submitted in person); certified true copies (if the application is submitted by post) of the following documents:

+ Certificate of registration of Vietnamese nationality of aircraft; and

+ Certificate of Airworthiness;

- An original of the aircraft operation and maintenance plan;

- Copies from the master register or copies presented together with their originals for comparison or certified true copies (if the application is submitted in person); certified true copies (if the application is submitted by post) of the following documents: Appropriate licenses and certificates of flight crew members;

- A copy from the master register or copy presented together with its original for comparison or certified true copy (if the application is submitted in person); certified true copy (if the application is submitted by post) of the operation license of the aircraft maintenance facility;

- A copy from the master register or copy presented together with its original for comparison or certified true copy (if the application is submitted in person); certified true copy (if the application is submitted by post) of the aircraft maintenance service lease contract in the case of leasing of aircraft maintenance service.

* Quantity: 01 set

(4) Processing time: Within 35 working days from the date of receipt of complete documents.

(5) Subjects carrying out administrative procedures: Organizations and individuals.

(6) Agencies handling administrative procedures:

- Authority with decision-making authority: Vietnam Aviation Administration.

- Authorized or decentralized authority or person to implement: No.

- Agency directly implementing administrative procedures: Vietnam Aviation Administration.

- Coordinating agency: No.

(7) Result of carrying out administrative procedures: Certificate of registration for general aviation activities.

(8) Fees and charges: 10,000,000 VND/time
