On June 27, 2024, the Government issued Decree 71/2024/ND-CP on land prices, including the Procedures forformulation of land price list in Vietnam as of January 1, 2026.
The initial formulation of the land price list to be announced and applied as of January 1, 2026, is carried out according to Article 14 of Decree 71/2024/ND-CP as follows:
The organization responsible for land valuation proceeds to create the land price list as follows:
Conduct investigation, survey, and gather information to serve the construction of the land price list by area and location; the land price list is created down to each plot based on value zones and standard plots;
Identify the type of land, area, and location at each commune, ward, or town regarding the area-based and location-based land price list; determine the type of land, total number of plots, number of plots of each type for the land price list down to each plot based on value zones and standard plots;
Compile and complete the investigation, survey, and information gathering results at the commune, district, and provincial levels; analyze and evaluate the current land price list results for the area and location-based land price lists;
Compile investigation, survey, and information gathering results; establish value zones; select and determine prices for standard plots; prepare a comparison ratio table for the land price list down to each plot based on value zones and standard plots;
Draft the land price list and explanatory report for constructing the land price list.
The Department of Natural Resources and Environment has the responsibility to draft a report proposing the issuance of the land price list; post the consultation dossier on the provincial People's Committee’s website and the Department of Natural Resources and Environment for 30 days; obtain written comments on the draft land price list from the provincial Vietnam Fatherland Front, its member organizations, tax authorities, state-owned notary organizations, and land valuation consultancy organizations; collect and finalize the draft report proposing the issuance of the land price list; direct the land valuation organization to collect and respond to feedback and finalize the draft land price list and explanatory report.
The Department of Natural Resources and Environment submits the land price list dossier for appraisal to the land price list Appraisal Council; the Appraisal Council appraises the land price list and sends the appraisal document to the Department of Natural Resources and Environment.
The Department of Natural Resources and Environment organizes the reception, response, adjustment, and completion of the draft land price list per the Appraisal Council's opinions; submits it to the provincial People's Committee.
The provincial People's Committee presents the land price list to the People’s Council at the same level for decision, publicly announces it, and directs the update into the national land database.
According to Clause 1, Article 159 of the Land Law 2024, land price lists are applied to the following cases in Vietnam:
To calculate land use fees when the State recognizes land use rights for residential land of households and individuals; changes the land use purpose for households and individuals;
To calculate land lease fees when the State leases land with annual land rent;
To calculate land use tax;
To calculate income tax from land use right transfer for households and individuals;
To calculate fees in land management and use;
To calculate fines for administrative violations in the land sector;
To calculate compensation payments to the State for damages in land management and use;
To calculate land use fees, land lease fees when the State recognizes land use rights in the form of land allocation with land use fees, leases land with a one-time land rental payment for the entire lease period for households and individuals;
To determine the starting price for land use right auctions when the State allocates or leases land with technical infrastructure investment according to detailed construction planning;
To calculate land use fees in the case of land allocation without land use right auctions for households and individuals;
To calculate land use fees when selling state-owned houses to current tenants.
Decree 71/2024/ND-CP is effective from the date the Land Law 2024 comes into effect, except for Article 37 of Decree 71/2024/ND-CP, which is effective from June 27, 2024.
