On June 25, 2024, Decree 70/2024/ND-CP was issued, guiding the Law on Identification 2023, which includes regulations on the procedures for extracting citizen information on the national population database from July 1, 2024.
To be specific, Article 10 of Decree 70/2024/ND-CP stipulates the procedures for extracting citizen information on the national population database through five methods as follows:
- The Identity Management Authority of the Ministry of Public Security issues accounts to agencies and organizations to access and retrieve information from the National Population Database;
- Agencies and organizations granted accounts by the Identity Management Authority of the Ministry of Public Security are responsible for creating and managing their own accounts on their information systems connected to the National Population Database and granting access rights to individuals under their jurisdiction according to assigned functions and tasks;
- Individuals granted access rights use their accounts to search and retrieve citizen information from the National Population Database through the agency's or organization's information system. The individual must enter the following information: Full name, date of birth, personal identification number, and choose other information they wish to retrieve from the National Population Database;
- The information system of the agency or organization sends an information retrieval request to the National Population Database using the account issued by the Identity Management Authority of the Ministry of Public Security. The retrieval results are provided in the form of either a paper document or an electronic document and stored in the connected information system;
- The Identity Management Authority of the Ministry of Public Security is responsible for verifying the account information and providing the retrieval results as requested, according to the account's access rights and the scope of information being retrieved.
- Agencies and organizations specified in Clause 1, Article 8 of Decree 70/2024/ND-CP access information in the National Population Database through the National Public Service Portal and the Public Service Portal of the Ministry of Public Security, following the connection, integration, and data sharing guidelines of the Ministry of Public Security;
- Organizations and individuals specified in Clauses 2 and 3, Article 8 of Decree 70/2024/ND-CP access information in the National Population Database through the National Public Service Portal and the Public Service Portal of the Ministry of Public Security, following the guidelines provided on the portals;
- Within 3 working days from the receipt of an information retrieval request in the National Population Database from agencies, organizations, or individuals, the authorized person specified in Article 9 of Decree 70/2024/ND-CP shall review and decide on granting access to information in the National Population Database to the agencies, organizations, or individuals specified in Article 8 of Decree 70/2024/ND-CP.
If approval for access is granted, the information will be provided to the requesting agency, organization, or individual. If access is denied, a written response stating the reasons for denial must be provided;
Information controllers confirm the content of agreements or disagreements to allow organizations or individuals not included in Clause 1, Article 8 of Decree 70/2024/ND-CP to access information in the National Population Database through the National Identification Application or other online public services.
- Citizens who have been issued electronic identity cards login to the National Identification Application to access their information in the National Population Database as guided on the National Identification Application;
- Organizations and individuals not specified in point a of this clause log in to the National Identification Application to access individual information in the National Population Database as guided on the National Identification Application; the information retrieval must be approved by the information subject through the National Identification Application.
- Agencies and organizations specified in Clause 1, Article 8 of Decree 70/2024/ND-CP connect directly to the electronic identification and authentication platform to access information in the National Population Database according to the agreement with the Ministry of Public Security;
- Organizations and individuals specified in Clauses 2 and 4, Article 8 of Decree 70/2024/ND-CP connect to the electronic identification and authentication platform through the information system of the electronic authentication service provider to access information in the National Population Database. Information retrieval will be carried out according to the agreement with the electronic authentication service provider and in compliance with Clause 5, Article 8 of Decree 70/2024/ND-CP.
- Agencies, organizations, and individuals submit a written request for information retrieval and provision from the National Population Database to the authorized person specified in Article 9 of Decree 70/2024/ND-CP;- The written request for information retrieval and provision must clearly state the purpose, content, and scope of information needed from the National Population Database and include a commitment to be responsible for using the information provided and the consent of the information subject for retrieval;
- Within 3 working days from the receipt of the written request for information retrieval from agencies, organizations, or individuals, the authorized person specified in Article 9 of Decree 70/2024/ND-CP shall review and decide on granting access to the information in the National Population Database;
If approval for information retrieval is granted, a written response and provision of information to the requesting agency, organization, or individual will be issued. If access is denied, a written response stating the reasons for denial must be provided.
