On October 31, 2024, the Ministry of Education and Training of VIetnam issued Decision 3278/QD-BGDDT to announce the amended and supplemented administrative procedures in the field of education and training with foreign entities under the management scope and function of the Ministry of Education and Training.

Procedures for extension and adjustment of foreign educational collaboration activities in Vietnam from November 20, 2024

(1) Implementation Steps:

Step 1: The collaborating parties submit documents to the Department of Education and Training.

Step 2: Within 5 working days from the date of receiving the documents, if the documents are not complete according to the regulations, the receiving authority will notify the collaborating parties in writing, which may be sent directly or via postal service or email.

Step 3: Within 10 working days from the date of receiving complete documents, the receiving authority organizes appraisal and decides to approve the extension or adjustment of educational collaboration;

In cases where the educational collaboration is not extended or adjusted, the receiving authority must provide a written response stating the reasons.

In cases where the educational collaboration adjustment involves adjusting the integrated educational program, the Department of Education and Training is responsible for sending the application for approval of the integrated educational program adjustment to the Ministry of Education and Training according to regulations.

(2) Method of Implementation:

Directly or via postal service or via the online public service portal.

(3) Composition and quantity of the application:

- Composition of the application:

+ Application form for extension or adjustment of educational collaboration;

+ Report summarizing the educational collaboration activities during the licensed period;

+ Effective cooperation agreement (contract) between the collaborating parties containing information as prescribed at point b, clause 1, Article 9 of Decree 86/2018/ND-CP;

- Quantity of the application: 01 set.

(4) Processing time:

10 working days, from the date of receiving a valid application.

In cases where the educational collaboration adjustment involves adjusting the integrated educational program, the processing time is at least 40 working days from the date of receiving the valid application (including the time for requesting the Ministry of Education and Training to approve the program adjustment).

(5) Entities implementing the administrative procedure:

- Vietnamese side: Private preschool educational institutions, private general education institutions invested and ensured operational conditions by domestic investors, established, and legally operating in Vietnam.

- Foreign side:

+ Educational institutions operating legally for at least 5 years abroad and not violating the laws of the host country during the operation, providing direct teaching, possessing a valid educational quality accreditation certificate, or being recognized for educational quality by competent foreign educational authorities or organizations.

+ Organizations providing educational programs legally established abroad, having operated educational programs for preschool or general education for at least 5 years up to the date of submitting the application for educational collaboration.

(6) Authority performing the administrative procedure:

Department of Education and Training.

(7) Requirements and conditions for performing the administrative procedure:

- The extension of educational collaboration must be done within 6 months before the educational collaboration expires.

- Conformable implementation under the Decision approving educational collaboration, with no violations of Vietnamese law and foreign law;
