Procedures for establishing ownership for property to be transferred to the Communist Party of Vietnam

On December 31, 2017, the Government of Vietnam promulgated Decree 165/2017/ND-CP on the regulations for the management and use of property at the Communist Party of Vietnam's agencies.

Under Decree 165/2017/ND-CP, when organizations or individuals propose transferring ownership of the property to an agency or unit, the proposed receiving agency/unit must base its assessment on the current legal regulations, determining the appropriateness of receiving the property transfer and will bear responsibility for the determination. If receiving transferred property is compliant with legal regulations, within 7 working days from the date of property receipt, the receiving agency/unit must prepare the application and submit it to the supervisory body (if any) for reporting to the competent authority to issue a decision on property ownership establishment according to regulations.

The application for the establishment of property ownership in Vietnam includes:

- A statement on the establishment of property ownership: 01 original copy;

- List of types, quantity, volume, value, and current condition of the property: 01 original copy;

- Contract for the property donation in case of transfer in the form of a gift and under legal provisions that it must be made into a contract: 01 original copy;

- Documents proving ownership, use rights of the transferred property, and the form of transfer (if any): 01 copy.

Within 7 working days from the date of receiving the complete applictaion as stipulated above, the competent authority or person shall review and issue the Decision on the establishment of property ownership.
