On October 5, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP stipulating the conditions for investment and operation in the field of education.

Conditions for establishing a public independent preschool in Vietnam from November 20, 2024

The establishment of an independent preschool in Vietnam must ensure the following conditions:

- Have a location, minimum facilities, teaching aids, toys, and educational equipment that meet the requirements of the preschool education program as prescribed by the Ministry of Education and Training.

- Have educational plans, materials, and resources that meet the requirements of the preschool education program as prescribed by the Ministry of Education and Training.

- Have a management team, teachers, staff, and workers that ensure the quantity and meet the standards as prescribed by the Ministry of Education and Training to organize nurturing, caring for, and educating children in compliance with the preschool education program requirements.

- The scale of groups and classes in the independent preschool must comply with the regulations of the Ministry of Education and Training of Vietnam.

Procedure for establishing a public independent preschool in Vietnam from November 20, 2024

Specifically, in Article 11 of Decree 125/2024/ND-CP, regulations on the procedure for establishing a public independent preschool in Vietnam from November 20, 2024, are specified as follows:

(1) The Chairman of the communal People's Committee decides to establish or permit the establishment of an independent preschool.

(2) Documentation:

- For the establishment of a public independent preschool, the dossier includes:

+ A report submitted to the Chairman of the district People's Committee on the establishment of a public independent preschool;

+ A document requesting an inspection of the actual conditions for establishment;

- To allow the establishment of a private, independent preschool, the dossier includes:

+ A proposal requesting permission to establish a private, independent preschool (according to Form No. 08 Appendix I attached to Decree 125/2024/ND-CP);

+ Copies of legal documents proving land use rights, house ownership rights, or rental contract for the location of the independent preschool;

+ Legal documents confirming the investment funds for establishing a private, independent preschool ensuring legality and appropriateness with the projected scale at the time of establishment.

(3) Implementation Procedure:

- establishing a public independent preschool in Vietnam:

The communal People's Committee reports to the Chairman of the district People's Committee on the establishment of a public independent preschool;

Within 5 working days from the date of consensus from the Chairman of the district People's Committee, the communal People's Committee sends a document requesting the Department of Education and Training to inspect the actual conditions for establishment.

- Establishing a private, independent preschool:

Organizations or individuals proposing the establishment send one set of documents via online public service portal, mail, or directly to the communal People's Committee;

Within 5 working days from the date of receiving a complete dossier, if the dossier is not valid, the communal People's Committee notifies in writing the contents to be amended and supplemented to the organization or individual; if the dossier is valid, a document is sent requesting the Department of Education and Training to inspect the actual conditions for establishment;

- Within 10 days from the date of receiving the document request from the communal People's Committee, the Department of Education and Training organizes on-site inspections and gives a written opinion to the communal People's Committee on whether the independent preschool meets the conditions for establishment;

- Within 5 working days from the date of receiving the response from the Department of Education and Training, the Chairman of the communal People's Committee decides on the establishment or allows the establishment of the independent preschool.

The decision to establish or allow the establishment of the independent preschool (according to Form No. 10 Appendix I attached to Decree 125/2024/ND-CP) is publicly announced on mass media.
