On September 13, 2024, the Ministry of Agriculture and Rural Development of Vietnam (MARD) issued Decision 3085/QD-BNN-TT announcing new administrative procedures, revised and supplemented in the field of crop production, including procedures for crop and livestock structure shift occurring on rice cultivation land in Vietnam at the communal People's Committee.

Procedures for crop and livestock structure shift occurring on rice cultivation land in Vietnam under Decision 3085

Decision 3085/QD-BNN-TT 2024 stipulates the procedures for crop and livestock structure shift occurring on rice cultivation land in Vietnam as follows:

(1) Implementation sequence:

- Step 1: Submit the dossier

The user of the rice cultivation land who wants to switch to perennial crops, rice farming combined with aquaculture, submits the dossier directly or via postal service or electronic environment to the communal People's Committee.

- Step 2: Response to the completeness of the dossier components

+ In the case of direct submission: The communal People's Committee reviews, checks, and responds immediately on the validity of the dossier;

+ In case of submission via postal service: Within 03 working days from the date of receipt of the dossier, the communal People's Committee reviews, checks, and responds on the validity of the dossier;

+ In case of submission through the electronic environment: Within 01 working day from the date of receipt of the dossier, the communal People's Committee reviews, checks, and responds on the validity of the dossier;

- Step 3: Appraisal of the dossier:

Within 05 working days from the date of receiving the valid dossier, the communal People's Committee reviews the conformity of the Registration Form with the annual Plan for changing the structure of crops and livestock on rice cultivation land of the commune:

+ If the Registration Form conforms to the annual Plan for changing the structure of crops and livestock on rice cultivation land of the commune, the communal People's Committee issues a written approval for the change according to the form in Appendix V issued with Decree 112/2024/ND-CP sent to the user of the registered rice cultivation land;

+ If the Registration Form does not conform to the annual Plan for changing the structure of crops and livestock on rice cultivation land of the commune, the communal People's Committee notifies in writing according to the form in Appendix VI issued with Decree 112/2024/ND-CP sent to the user of the rice cultivation land.

(2) Method of implementation: Directly or via postal service or electronic environment

(3) Components and quantity of the dossier:

- The dossier includes:

A Registration Form for changing the structure of crops and livestock on rice cultivation land according to the form in Appendix IV issued with Decree 112/2024/ND-CP.

- Quantity: 01 dossier set.

(4) Time limit for settlement: Issuance of a written approval for the change of the structure of crops and livestock on rice cultivation land: 05 working days from the date of receiving a valid dossier.

(5) Subjects implementing administrative procedures: Organizations, individuals (users of rice cultivation land).

(6) Administrative procedure handling agency: Communal People's Committee.

(7) Result of administrative procedures:

- Written approval for the change of the structure of crops and livestock on rice cultivation land according to the form in Appendix V issued with Decree 112/2024/ND-CP;

- Written disapproval of the registration form for changing the structure of crops and livestock on rice cultivation land according to the form in Appendix VI issued with Decree 112/2024/ND-CP.

(8) Fees, charges (if any): None.

(9) Name of the form, declaration:

- Registration Form for changing the structure of crops and livestock on rice cultivation land according to the form in Appendix IV issued with Decree 112/2024/ND-CP dated September 11, 2024 of the Government of Vietnam detailing rice cultivation land.

(10) Requirements, conditions for implementing administrative procedures (if any): Not specified

(11) Legal basis of administrative procedures:

Article 8 Decree 112/2024/ND-CP dated September 11, 2024 of the Government of Vietnam detailing rice cultivation land in Vietnam.
