Regarding this issue, LawNet would like to answer as follows:
On March 23, 2024, the Minister of Health issued Decision 702/QD-BYT announcing replaced administrative procedures in the field of emulation and commendation under the Ministry of Health in Decree 25/2024/ND-CP dated February 27, 2024 of the Government regulations on consideration for awarding the title "People's Doctor" or "Doctor of Merit".
Step 1: Individuals propose considering granting establishment or authorization to individuals or other organizations to prepare applications for awards according to the provisions of Clause 1 and Clause 2 of Article 14 of Decree 25/2024/ND-CP, and directly submit the application for awards in paper form (original copy), while also attaching electronic files or submitting the application for awards online or through postal services to the Grassroots-Level Council (via the Standing Committee of the Council).
Step 2:
- The Standing Committee of the Grassroots Council performs the following tasks:
+ Submit to the competent authority to decide on the establishment of a Grassroots Council to consider awarding the title "People's Doctor", "Doctor of Merit" and a Secretariat to assist the Council;
+ Verify the validity of documents included in the file; Receive and summarize recommendations from individuals and organizations (if any) and report them to the competent person for handling;
+ Make a list of individuals proposed for consideration, accompanied by a summary of each individual's achievements;
+ Submit to the Head of the Unit to decide on organizing a conference of cadres, civil servants, public employees, and workers to get votes to determine the level of trust and respect of patients and colleagues towards the individual requesting consideration for donation (hereinafter referred to as votes).
The conference is only considered valid when at least 3/4 of the officials, public employees, and workers with intermediate or higher qualifications are summoned to attend the meeting, including at least 2/3 of the officials, public employees, and workers with intermediate medical and pharmaceutical degrees or higher convened in the unit to participate in the Conference.
For units with a number of officials, public employees, and workers of 500 or more: the organization of the introduction and ballot collection is decided and guided by the head of the unit. The results of the consultation must be recorded in writing. Individuals requesting consideration for a donation must have at least 80% of the total number of people agreeing out of the total number of people participating in the consultation to be proposed for consideration at the Grassroots Council;
+ Summarize and send documents specified in Point c of this Clause to members of the Council and organize meetings of the Council.
- The grassroots council performs the following tasks:
+ The Council holds a meeting and votes by secret to select an individual who is qualified to be awarded the title "People's Doctor" or "Doctor of Merit." Individuals who achieve at least 90% of the votes in favor of the total number of members of the Council according to the establishment decision will be included in the list submitted to the Superior Council for consideration;
+ Notification in the form of publicly posting the list of Council selection results at the unit's headquarters and posting it on the agency's website within 10 days;
+ In case of feedback or recommendations, the Council is responsible for reviewing and reporting to the competent person for handling according to the provisions of law;
+ After the notification period in Point b of this Clause expires, the Grassroots Council completes the donation consideration dossier and submits it to the Chairman of the Grassroots Council to sign the Proposal and submit it to the Ministerial and Provincial Council for consideration.
Step 3:
- The Ministerial and Provincial Councils receive documents from the Grassroots Council.
- The Standing Council of the Ministerial and Provincial Council receives and appraises the composition and validity of documents contained in the dossier submitted by the Grassroots Council; Receive, review, and report to the person with authority to resolve complaints related to the awarding of titles (if any); Send documents specified in Points dd, e, and g, Clause 6, Article 14 of Decree 25/2024/ND-CP to members of the Council and organize meetings of the Council.
- The Ministerial and Provincial Councils carry out the following tasks:
+ Meeting and secret ballot to select individuals qualified to be awarded the title "People's Doctor" or "Doctor of Merit". Individuals who achieve at least 90% of the votes in favor of the total number of Council members according to the establishment decision will be included in the list submitted to the Superior Council for consideration;
+ Publicly announce the selection results on the media of the ministry and province within 10 days;
+ In case of feedback or recommendations, the Council is responsible for reviewing and reporting to the competent person for handling according to the provisions of law;
+ After the notification period in Point b of this Clause expires, the Grassroots Council completes the donation consideration dossier and submits it to the Chairman of the Ministerial and Provincial Council to sign the proposal and submit it to the State Council for consideration.
- The Standing Committee of the Provincial Party Committee, City Party Committee and Party Committee of ministries and branches shall review and give written opinions before submitting them to the State Council for individuals requesting to be considered for the title "Doctor of Merit" under management authority and individuals requesting to be considered for the title "People's Doctor".
Step 4:
- The State Council receives documents from the Ministerial and Provincial Councils.
- The Standing Committee of the State Council receives and appraises the composition and validity of documents contained in the dossiers submitted by the Ministerial and Provincial Councils; Receive, review, and report to the person with authority to resolve complaints related to the awarding of titles (if any); Send documents specified in Points dd, e, g, Clause 6, Article 14 of Decree 25/2024/ND-CP to members of the Council and organize meetings of the Council.
- The State Council performs the following tasks:
+ Meeting and secret ballot to select individuals who meet the qualifications and criteria to be awarded the title "People's Doctor", "Doctor of Merit." Individuals who achieve at least 90% of the votes in favor of the total number of Council members according to the establishment decision will be included in the list for submission to the Prime Minister for consideration and submission to the President for decision;
+ Announcement of the selection results on the Government Electronic Information Portal, Ministry of Health Electronic Information Portal, and Health and Life Newspaper within 10 days;
+ In case of feedback or recommendations, the Council is responsible for reviewing and reporting to the competent person for handling according to the provisions of law;
+ After the notification period specified in Point b of this Clause expires, the State Council completes the donation consideration dossier and submits it to the Chairman of the State Council. The Ministry of Health sends it to the Ministry of Home Affairs for evaluation, submits it to the Prime Minister for consideration, and submits it to the President for decision.
