Regarding this issue, LawNet would like to answer as follows:

On December 26, 2023, the Minister of Foreign Affairs issued Circular 06/2023/TT-BNG amending Circular 01/2011/TT-BNG regulating procedures for granting permits for the entry of human corpses, remains and ashes into Vietnam; Circular 02/2011/TT-BNG guiding procedures for citizenship registration by overseas Vietnamese; Circular 04/2020/TT-BNG on guidelines for the issuance, renewal or revocation of diplomatic or official passports, and issuance of diplomatic notes requesting visas from foreign countries

Procedures for citizenship registration by overseas Vietnamese from February 15, 2024

Procedures for citizenship registration by overseas Vietnamese from February 15, 2024 will be specified as follows:

(1) Applicants for registration of Vietnamese citizens abroad submit 01 set of documents including:

- 01 fully completed citizen registration form (can be declared online on the representative agency's website);

- 01 photocopy of Vietnamese passport or other document with value to replace Vietnamese passport in case the person has a Vietnamese passport or other document with value to replace Vietnamese passport that is still valid;

- 01 photocopy of a document with a personal identification number in case the person does not have one of the following documents, such as a Vietnamese passport or another document that can replace a valid Vietnamese passport, but has one in the documents proving that they have Vietnamese nationality.

In case a Vietnamese citizen does not have a personal identification number, submit 01 photocopy of identification documents and 01 photocopy of documents proving Vietnamese nationality as prescribed in Article 11 of the 2008 Vietnamese Nationality Law (amended 2014). (Birth certificate; identity card; Decision to grant Vietnamese nationality, Decision to restore Vietnamese nationality, Decision to recognize adoption of foreign children, Decision to allow foreigners to adopt Vietnamese children ).

- 01 stamped envelope and recipient's address in case the applicant wants to receive results by mail.

Currently in Circular 02/2011/TT-BNG, each citizenship registrant shall submit 1 dossier, comprising:

- A completed citizenship registration form (which can be filled in online on websites of representative missions);

- A copy of the Vietnamese passport or passport substitute, for the cases specified in Clause 1. Article 2 of this Circular;

- A copy of the personal identity paper and a copy of the paper proving Vietnamese nationality provided in Article 11 of the 2008 Law on Vietnamese Nationality (certificate of birth: identity card; decision permitting nationalization in Vietnam, decision permitting restoration of Vietnamese citizenship, decision recognizing adoption of a foreign child or decision permitting a foreigner to adopt a Vietnamese child), for the cases specified in Clause 2. Article 2 of Circular 02/2011/TT-BNG.

- A stamped addressed envelope, in case the registrant wishes to receive dossier-processing results by post.

(2) Citizenship registration applications may be submitted directly or by post to representative missions.

Documents can be submitted electronically if the technical infrastructure at the representative agency is eligible for this matter (including connection to the national population database) (Additional regulations)

(3) Within 1 working day after receiving a complete and valid dossier, the representative mission shall examine and check information declared in the citizenship registration form against other papers in the dossier; and on that basis, process the dossier and notify the results in writing to the registrant.

(4) In case none of papers proving Vietnamese citizenship is available or such papers need further examination or verification, the representative mission shall guide the registrant to carry out procedures to verify his/her Vietnamese citizenship according to the nationality law. Upon receiving verification results from competent agencies, the representative mission shall immediately process the dossier and notify the results in writing to the registrant.
