Regarding this matter, LawNet would like to answer as follows:

On February 5, 2024, the State Bank of Vietnam issued Decision 197/QD-NHNN introducing amended, replaced, and annulled administrative procedures for other activities currently carried out in the Single-Window Division under the management scope of the State Bank of Vietnam.

1. Conditions for awarding the title of Emulation Fighter in the banking sector in Vietnam

The conditions for awarding the title of Emulation Fighter in the banking sector are stipulated in Article 22 of the Law on Emulation and Commendation 2022 as follows:

- Individuals with outstanding achievements selected among those who have been awarded the "Grassroots-Level Emulation Fighter" title three times in a row;

- Individuals with effective and replicable initiatives within the Ministry, department, or province, or with scientific topics, scientific projects, scientific works, and technologies that have been reviewed and effectively applied, with a significant impact within the Ministry, department, or province, or with intellectual creativity and innovation in combat or serving combat with a nationwide impact.

- The heads of the Ministry, department, and province shall review and recognize the effectiveness, replicability, and scope of impact of the initiatives, scientific topics, scientific projects, scientific works, and technologies within the Ministry, department, and province.

2. Procedures for awarding the title of Emulation Fighter in the banking sector in Vietnam as of February 28, 2024

The procedures for awarding the title of Emulation Fighter in the banking sector is as follows:

- Step 1: The State Bank (Organizational Personnel Department) shall receive applications before March 31st of each year for units under the State Bank of Vietnam, Vietnam Deposit Insurance, enterprises, associations under the management of the State Bank of Vietnam, credit institutions, and branches of foreign banks. For training institutions, applications shall be received before August 15th of each year.

- Step 2: After receiving the applications from the unit, the Organizational Personnel Department shall verify the legality of the documents, appraise the achievements, compile them, and submit them to the Banking Sector Innovation Council and the Emulation - Commendation Council of the banking sector for review. Based on the approved results of the Councils, the Organizational Personnel Department shall submit to the First Deputy Chairman of the Emulation - Commendation Council of the banking sector for opinions before submitting to the Governor for a decision. If necessary, the Organizational Personnel Department shall seek opinions from relevant units before compiling the commendation submission.

- Step 3: The Governor of the State Bank of Vietnam shall decide to award the title "Emulation Fighter in the banking sector".

3. Application for consideration of the title of Emulation Fighter in the banking sector in Vietnam

The application dossier for consideration of the title of Emulation Fighter in the banking sector includes:

- Recommendation letter for commendation from the Head of the unit, accompanied by a list of individuals recommended for commendation.

- Summary report of the achievements of the individual recommended for commendation. The report of achievements shall be kept at the unit.

- Proposal to recognize the effectiveness of application, scope of impact, and replicability of the initiative, accompanied by a summary of the initiative at the sector level of the individual or a decision to recognize the scientific topic at the sector level.

- Meeting minutes with the enclosed results of a secret ballot by the unit's Emulation - Commendation Council, with a voting rate of 90% or higher based on the total number of members of the Council (if Council members are absent, their opinion shall be obtained in writing).
