Regarding this issue, LawNet would like to answer as follows:
The Ministry of Education and Training issued Decision 2344/QD-BGDDT dated August 14, 2023, announcing internal administrative procedures between State administrative agencies within the scope of the Ministry's management functions.
According to Decision 2344/QD-BGDDT, the procedure for awarding the Certificate of Merit by the Minister of Education and Training is prescribed as follows:
(1) Subjects performing the procedure
- Departments, Bureaus, Inspectorates, Offices, Executive Boards, Project Management Boards, schemes, and programs under the Ministry of Education and Training (collectively referred to as units under the Ministry's Agencies);
- Public service units under the Ministry of Education and Training and Vietnam Education Publishing House (collectively referred to as units under the Ministry);
- Hanoi National University, Ho Chi Minh City National University (collectively referred to as the National University);
- Pedagogical colleges, higher education institutions directly under the People's Committees of provinces and centrally run cities (collectively referred to as provincial schools); higher education institutions under ministries, ministerial-level agencies, and government agencies (collectively referred to as ministerial schools);
- Member units of regional universities, Vietnam Education Publishing House, and national universities;
- Faculties, departments, divisions, and equivalent organizations under units: under Ministry agencies, under ministries, provincial schools, schools under ministries, regional universities, Vietnam Education Publishing House, National University;
- Departments of Education and Training, Offices of Education and Training, divisional units under the Department of Education and Training;
- Preschool education establishments, general education, continuing education, specialized schools, and other educational establishments belonging to the national education system;
- Officials, civil servants, public employees, workers (recruited for 10 months or more) and learners in agencies and units specified in this Clause.
(2) General requirements for implementing procedures
No reward quotas are imposed, ensuring the principle of voluntary participation in reward consideration by groups and individuals according to regulations.
Reward consideration must be based on standards and achievements with specific and practical evidence and products of the collective and individual.
The evaluation and recognition of emulation titles and the scope of influence of achievements must be based on the results of the evaluation and classification of civil servants, public employees, and workers; ensure that no more than 1/3 of the number of civil servants, public employees, and workers awarded the Ministerial Commendation Certificate are managers.
Collectives and individuals proposed to be awarded the Ministerial Certificate of Merit must have a vote of 70% or more of the total number of members of the grassroots emulation and commendation council.
(3) Sequence of performing procedures
- Applications for rewards based on merit and achievements and rewards for dedication are sent to the Ministry before August 31 every year for units considering emulation based on school year and before January 31 every year for units considering emulation based on years of service.
- Dossier to request an unexpected reward: Immediately after a collective or individual achieves an achievement, the head of the unit is responsible for submitting it to the Minister for consideration and decision on reward, or for the Minister to submit to the competent authority for consideration and decision on reward.
- Records of rewards by batch (or topic): Before requesting rewards by batch (or topic), units agree with the Department of Personnel and Organization on the reward subjects and criteria; The unit then submits to the Ministry leader in charge for approval of the reward policy. After selecting collectives and individuals with excellent achievements, the unit sends the Department of Personnel and Organization a batch (or thematic) reward dossier for appraisal and submission to the Ministry's leadership for consideration and decision on reward.
