On January 19, 2024, the Ministry of Transport issued Decision 60/QD-BGTVT announcing amended, supplemented, and abolished administrative procedures in the road sector within the scope of the management functions of the Ministry of Transport.

Procedures for approving plans for traffic organization on expressway in Vietnam

(1) Implementation order:

* Submit administrative procedure documents:

The investor or investor is responsible for preparing a traffic organization plan and submitting it to the competent authority for review and approval before putting the project into operation, specifically:

- The Vietnam Road Administration is responsible for approving and adjusting plans for traffic organization on expressways according to the hierarchy and delegation of authority for expressways managed by the Ministry of Transport or expressways for which the Ministry of Transport is the competent authority for investment projects under the public-private partnership method. It also approves and adjusts traffic organization plans for expressways operated by enterprises under the State Capital Management Committee's management and operation.

- The Vietnam Expressway Authority is responsible for approving and adjusting plans for traffic organization on expressways according to the hierarchy and delegation of authority for expressways managed by the Ministry of Transport or expressways for which the Ministry of Transport is the competent authority for investment projects under the public-private partnership method.

- Provincial People's Committee approves and adjusts plans for traffic organizations on expressways under management.

* Resolving administrative procedures:

- Competent authority to handle and receive documents. In case the dossier is not clear or complete according to regulations, no later than 02 working days from the date of receipt of the dossier, there must be a written request to the investor or investor to supplement and complete the dossier;

- The authority competent to approve the traffic organization plan assigns the expressway management agency to evaluate the file. The appraisal time must not exceed 05 (five) working days from the date of receipt of the complete documents as prescribed. After receiving the appraisal report, if eligible, make a decision to approve the traffic organization plan within 03 (three) working days. In cases of disapproval, there must be a written response clearly stating the reason.

(2) Submission methods:

- Send directly, via the postal system, or in another suitable form.

(3) Components and quantity of documents:

* Profile components:

- Application for approval (original) according to the form;

- Traffic organization plan.

* Number of documents: 01 set.

(4) Processing time limit:

- Appraisal time: no more than 05 working days from the date of receipt of complete documents according to regulations;

- Time to make an approval decision: 03 working days from the date of the appraisal report meeting the conditions for approval.

(5) Subjects performing administrative procedures:

- Organizations and individuals.

(6) Agencies implementing administrative procedures:

- Competent agency: Vietnam Road Administration, Vietnam expressway Administration, Provincial People's Committee;

- Authority or competent person authorized or decentralized to implement: None;

- Agencies directly implementing administrative procedures: Vietnam Road Administration, Vietnam expressway Administration, Provincial People's Committee;

- Coordinating agency: None.

(7) Results of implementing administrative procedures:

- Decision to approve plans for traffic organization on expressways.
