The following article contains information on the procedures for approval of educational operations of secondary schools in Vietnam from November 20, 2024, as stipulated in Decree 125/2024/ND-CP.

On October 5, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP stipulating the regulatory requirements for educational investment and business operation in Vietnam.

According to the provisions of Article 28 Decree 125/2024/ND-CP, the procedures for approval of educational operations of secondary schools in Vietnam are as follows:

- The Head of the Department of Education and Training decides to authorize educational activities for junior high schools; The Director of the Department of Education and Training decides to authorize educational activities for high schools.

- The dossier includes:

+ Application for authorization of educational activities;

+ Copies of legal documents proving land use rights, house ownership rights, or school site lease agreements with a minimum term of 5 years;

+ For private high schools, there must be legal documentation confirming the amount of money managed by the school, ensuring legality and suitability with the prospective scale at the time of registering for educational activities;

+ The school's organizational and operational regulations, including the following main contents: Legal status, duties, and powers of the school; organization and management of the school; organization of educational activities in the school; duties and rights of management staff, teachers, employees, and students; finance and assets of the school; other issues related to the organization and activities of the school.

- Implementation procedure:

+ The high school submits 1 dossier set as specified in Clause 2, Article 28 of Decree 125/2024/ND-CP through the online public service portal, by post, or directly to the Department of Education and Training for junior high schools or Department of Education and Training for high schools;

+ Within 5 working days from the receipt of the complete dossier, the Department of Education and Training or Department of Education and Training notifies in writing the content that needs to be amended, supplemented to the high school if the dossier is invalid; or announces the plan for actual appraisal at the school in case the dossier is valid;

+ Within 20 days from receiving the valid dossier, the Department of Education and Training or Department of Education and Training presides, cooperates with relevant specialized units to organize the actual appraisal of conditions for the high school to operate educational activities; prepares an appraisal report to assess the compliance with the provisions in Article 27 Decree 125/2024/ND-CP;

+ Within 5 working days from the date of having the appraisal report, if the conditions are met, the Head of the Department of Education and Training or Director of the Department of Education and Training decides to authorize the high school to operate educational activities; if conditions are not met, a written notice is given to the high school stating the reasons.

The decision to authorize the high school to operate educational activities is publicly announced on mass media.

More details can be found in Decree 125/2024/ND-CP which comes into force in Vietnam from November 20, 2024.

Decree 125/2024/ND-CP replaces Decree 46/2017/ND-CP of the Government of Vietnam regulating conditions for investment and operation in the field of education and Decree 135/2018/ND-CP of the Government of Vietnam amending and supplementing several articles of Decree 46/2017/ND-CP of the Government of Vietnam regulating conditions for investment and operation in the field of education.
