Procedures for appraisal of applications and draft Vietnam Standard

Recently, the Ministry of Culture, Sports and Tourism of Vietnam issued Circular 05/2013/TT-BVHTTDL on formulation of Vietnam standards and national technical regulations.

According to Article 12 of Circular 05/2013/TT-BVHTTDL on the appraisal of application and draft Vietnam Standard:

- Within 15 days from the date of receipt of a complete and valid application for appraisal of the draft national standard, the Minister of Culture, Sports and Tourism shall decide to establish the Appraisal Council at the proposal of the Director of the Department of Science, Technology, and Environment.

Composition of the Appraisal Council:

+ The Appraisal Council shall consist of 5 to 7 members, including the Chairman and other members, as follows:

- Representatives of relevant agencies and units under the Ministry of Culture, Sports and Tourism related to the object of national standard construction (accounting for at least 1/2 of the Council members);

- Reputable experts inside and outside the Ministry with appropriate professional qualifications and deep understanding of the national standard group;

- Representatives of specialized management agencies under the Ministry of Culture, Sports and Tourism and the representatives of the Directorate for Standards, Metrology and Quality;

- Members of the Technical Committee shall not be members of the Appraisal Council.

+ The Secretary of the Council shall be an expert from the Department of Science, Technology, and Environment.

- Within 30 days from the date of the decision establishment, the Appraisal Council must hold a meeting to appraise the application and draft Vietnam Standard.

- Responsibilities of the Appraisal Council:

- Review and evaluate the completeness and validity of the application and draft Vietnam Standard as stipulated in point g, clause 2, Article 11 of this Circular;

- Comply with the regulations stated in clauses 4 and 5 of this Article, ensuring an honest, objective, accurate, and fair evaluation;- Bear personal responsibility for their evaluation results and collective responsibility for the general conclusions of the Appraisal Council.

- Working principles of the Appraisal Council:

- Members shall publicly discuss and be responsible for their opinions;

- At least 2/3 (two-thirds) of the members must be present at the Appraisal Council meetings (written opinions of absent members are for reference only);

- The Chairman of the Appraisal Council shall preside over the meetings.

- Contents of the Appraisal Council's meeting:

- Members of the Appraisal Council shall comment on the application and draft Vietnam Standard according to the Evaluation Form for Draft National Standards stipulated in Appendix X issued with this Circular;

- The conclusions of the Appraisal Council shall be recorded in the minutes of the Council meeting according to the form stipulated in Appendix XI issued with this Circular. The conclusions of the Council are the basis for completing the application and draft Vietnam Standard to propose to the Ministry of Science and Technology for appraisal.
