Regarding this issue, LawNet would like to answer as follows:

The Ministry of Labor, War Invalids, and Social Affairs of Vietnam issued Decision 292/QD-LDTBXH dated 16/3/2023 on the announcement of administrative procedures to amend and supplement the field of social protection within the scope of state management functions of the Ministry of Labor, War Invalids, and Social Affairs.

Thus, the procedures for requesting monthly care and nurturing funding support are prescribed as follows:

1. Conditions for carrying out the procedures for requesting monthly care and nurturing funding support in Vietnam

Subjects and guardians of subjects specified in Article 5; households and individuals receive monthly care and nurture in the community as prescribed in Clause 1, Article 18 of Decree 20/2021/ND-CP.

2. Components of the application for monthly care and nurturing funding in Vietnam

Individuals prepare 01 set of dossiers of requests for monthly care and nurturing funding, including the following components:

- Declaration of households with people with disabilities (according to Form No. 2a issued together with Decree 20/2021/ND-CP);

Declaration of households with people with disabilities

- Declaration for taking care of and nurturing social protection subjects (under Form No. 2b issued together with Decree 20/2021/ND-CP);

Declaration for taking care of and nurturing social protection subjects

- Declaration of subjects receiving care and nurture in case the subjects are not entitled to monthly social allowance (under Form No. 03 issued together with Decree 20/2021/ND-CP).

3. Procedures for applying for monthly care and nurturing funding in Vietnam

Procedures for applying for monthly care and nurturing funding include:

- Step 1: The subject, the subject's guardian, or the relevant organization or individual shall make a dossier according to regulations and send it to the President of the People's Committee of the commune, ward, or township where he/she resides.

When submitting the application, it is necessary to present the following documents (in case of direct submission) for the receiving officer to compare the information declared in the declaration:

+ Certificate of residence information or Notice of personal identification number and citizen information in the national database on population; identity card or citizen identification card;

+ Birth certificates of children, for the case of consideration of social allowances for children, poor single people who are raising children, and people with disabilities who are raising children;

+ A certificate of HIV infection from a competent health agency, for cases of HIV infection;

+ A certificate of pregnancy from a competent health agency in case the disabled person is pregnant;

+ Certificate of disability for people with disabilities.

- Step 2: Within 07 working days from the date of receipt of complete dossiers, the civil servant in charge of Labor - Invalids and Social affairs shall review the dossier and submit it to the chairman of the commune-level People's Committee to organize the consideration and decision on the approval; publicize the results of the review and approval at the headquarters of the commune-level People's Committee within 2 working days, except for information related to HIV/AIDS of the subject.

If there is a complaint, within 10 working days from the date of receipt of the complaint, the chairperson of the commune-level People's Committee shall organize the review, conclusion, and publicity of the complaint contents.

- Step 3: Within 03 working days from the date the application is approved and there is no complaint, the President of the commune-level People's Committee shall send a written request together with the subject's dossier.

- Step 4: Within 07 working days from the date of receiving the subject's dossier and the written request of the President of the commune-level People's Committee, the Division of Labor - Invalids and Social Affairs is responsible for appraising it and submitting it to the Chairman of the People's Committee of the district, town, or provincial city to decide on a monthly social allowance, monthly care, and nurturing funding for the subject.

In case the subject is not eligible for benefits, the Division of Labor - Invalids, and Social Affairs shall reply in writing and clearly state the reason.

- Step 5: Within 03 working days, from the date of receiving the written submission from the Department of Labor - Invalids and Social Affairs, the chairpersons of district-level People's Committees shall consider and decide on monthly social allowances and monthly care and nurturing funding support for subjects.

* Method of implementation: In person, by post, or online (if conditions permit).

* Processing time: 22 working days.
