Regarding this matter, LawNet would like to answer as follows: 

On April 11, 2024, the Ministry of Transport issued Decision 421/QD-BGTVT on the announcement of newly issued administrative procedures related to transportation under the Ministry of Transport, taking effect on May 15, 2024.

The procedures for adjusting information on licenses to transport dangerous goods when there are changes are as follows:

* Submitting applications:

The individual that uses a land motor vehicle or an inland watercraft to transport dangerous goods (hereafter referred to as "carrier") submits the applications to the agency responsible for issuing licenses to transport dangerous goods, specifically:

- The Ministry of Public Security grants licenses to transport dangerous goods of class 1, 2, 3, 4, and 9 as regulated in Article 4 of Decree 30/2024/TT-BGTVT (except for plant protection chemicals and organizations or enterprises under the management of the Ministry of Defense).

- The Ministry of Defense grants licenses to transport dangerous goods to organizations and enterprises under its management.

- The Ministry of Science and Technology grants licenses to transport dangerous goods of class 5 and 8 as regulated in Article 4 of Decree 30/2024/TT-BGTVT.

- The People's Committees of provinces and centrally-run cities grant licenses to transport dangerous goods for plant protection chemicals.

* Handling administrative procedures:

- In the case of direct submission: the agency handling the administrative procedure checks the application and provides an immediate response when the organization or individual submits the application; in the case of an incomplete or incorrect application, guidance for completing the application is provided as per regulations.

In the case of submission through postal services or online public service systems: Within a period not exceeding 01 working day from the date of receiving the file, the agency handling the administrative procedure reviews the completeness of the application. If the application is incomplete according to regulations, the agency handling the administrative procedure notifies the organization or individual in writing or through the online public service system to supplement the application, while providing guidance for completing the application as per regulations.

- Within a period of 03 working days from the date of receiving a complete application as per regulations, the agency issues a document adjusting the content of licenses to transport dangerous goods. In the case of not agreeing, the agency issuing the document must provide a written response or notify through the online public service system, stating the reason.

Components of the application for adjusting information on licenses to transport dangerous goods when there are changes in Vietnam

Components of the application include:

- Application for adjusting information on licenses to transport dangerous goods according to the prescribed form.

- Supporting documents demonstrating the changes in information related to the license.

Number of application: 01 set.

Agencies responsible for handling the procedure for adjusting information on licenses to transport dangerous goods when there are changes in Vietnam

- Competent agencies for handling: Ministry of Public Security, Ministry of Defense, Ministry of Science and Technology, People's Committees of provinces, and centrally-run cities.

- Authorized or delegated agency or person to perform: None.

- Directly implementing administrative procedures: Ministry of Public Security, Ministry of Defense, Ministry of Science and Technology, People's Committees of provinces and centrally-run cities.

- Coordinating agency: None.
