On May 23, 2024, the Politburo issued Regulation 148-QD/TW concerning the authority of the head in temporarily suspending the work of subordinate officials in cases of necessity or when there are indications of serious violations of the Vietnam Communist Partys regulations or the State's law.

Duration of Temporary Suspension for Subordinate Officials in Cases of Necessity or Serious Violations of the Vietnam Communist Party's Regulations, State Law of Vietnam

Article 10 of Regulation 148-QD/TW dated May 23, 2024, stipulates the duration of temporary suspension for subordinate officials in cases of necessity or serious violations of the Vietnam Communist Party's regulations, State law of Vietnam as follows:

- The duration of temporary suspension in necessary cases should not exceed 15 business days. In case of extension, the extension period should not exceed 15 business days.

- The duration of temporary suspension in cases of signs of serious violations of the Communist Party's regulations, State law is determined according to the recommendation of the proceedings-conducting body, inspection, auditing, execution.

- The decision of temporary suspension automatically expires when the suspension period ends.

Article 11 of Regulation 148-QD/TW dated May 23, 2024, stipulates the procedures and management of temporary suspension records for subordinate officials in cases of necessity or serious violations of the Communist Party's regulations, State law of Vietnam as follows:

Procedures for Temporary Suspension

- Upon determining that there are grounds for temporary suspension as stipulated in Article 4, Article 5 of Regulation 148-QD/TW, the personnel organization department (HR) must advise the head to issue a decision of temporary suspension for the officials no later than 2 business days.

- No later than 2 business days from the date of receiving the proposal from the personnel organization department (HR), the head shall issue the decision of temporary suspension for the officials.

- Within 3 business days from the date of having sufficient grounds to cancel the temporary suspension decision, the head shall issue the decision to cancel the temporary suspension decision for the officials.

- The decision of temporary suspension and the decision to cancel the temporary suspension decision shall be sent to the temporarily suspended officials, announced within the agency, unit using the officials, and sent to relevant agencies, units, individuals.

Management of Records

The decision of temporary suspension, the decision to cancel temporary suspension, and related documents must be filed into the officials' records, managed, and used according to regulations.
