According to the Education Law 2019, continuing education is education aimed at implementing a specific educational program, organized flexibly in terms of form, time, methods, and location to meet the lifelong learning needs of learners. Continuing education aims to create conditions for individuals to study while working, to learn continuously, and to engage in lifelong learning to enhance personal abilities, complete personality development, expand knowledge, and improve educational, professional, and vocational levels for employment, self-employment, and to adapt to social life; contributing to building a learning society.
A continuing education center is one of the forms of continuing education institutions. Decision 1766/QD-BGDDT issued on July 1, 2024, announces newly issued internal administrative procedures and replaced internal administrative procedures within the state administrative system under the management of the Ministry of Education and Training of Vietnam. Among these, the procedures for establishing a continuing education center are published based on Decree 46/2017/ND-CP and Decree 135/2018/ND-CP as follows:
(1) Procedure Sequence:
- The Department of Education and Training submits directly or via postal service 01 set of documents to the Department of Home Affairs to request evaluation;
- Within 10 working days from the date of receipt of a complete and valid dossier, the Department of Home Affairs organizes the evaluation and forwards the dossier to the Provincial People's Committee for verification;
- Within 05 working days from the date of receipt of a complete and valid dossier, the Chairman of the Provincial People's Committee decides to establish the continuing education center. If not, the Department of Education and Training will be notified in writing, specifying the reasons.
(2) Method of Implementation: Directly or via postal service.
(3) Components and Quantity of Dossier:
- Components of the dossier:
+ Official Dispatch proposing the establishment of the provincial-level continuing education center by the Department of Education and Training;
+ Scheme for establishing the continuing education center, clearly stating the need for permitting the center's activities, the orientation of the center’s activities, conditions for facilities, and a management team and teachers according to regulations;
+ Curriculum vitae of the proposed Director of the center.
- Quantity of dossier: 01 set.
(4) Resolution Time: 15 working days.
(5) Subjects of Administrative Procedures: Department of Education and Training.
(6) Administrative Authority: Provincial People's Committee.
(7) Result of Administrative Procedures: Decision to establish the continuing education center by the Chairman of the Provincial People's Committee.
(8) Fee, charges: None.
(9) Name of Application Form, Form of Declaration: None.
(10) Requirements and Conditions for Implementation of Administrative Procedures:
- Having a management team and teachers meeting the standards as per regulations.
- Having a location to construct facilities and equipment according to the following regulations:
+ Sufficient classrooms, laboratories, libraries, and rooms for practical labor production;
+ Educational equipment and study materials are required for the implementation of continuing education programs.
