On November 5, 2024, the Minister of Home Affairs of Vietnam issued Decision 780/QD-BNV to announce administrative procedures stipulated in Decree 126/2024/ND-CP concerning the organization, operation, and management of associations.
(1) Procedure Steps
- Step 1: Founders submit an application for recognizing the steering committee for establishing an association with national or inter-provincial scope to the Ministry or equivalent agency that manages the primary field of operation of the proposed association.
- Step 2: The file-receiving officer reviews the application and requests additional documents if the application is incomplete or not legal. If the application is rejected, the reason must be clearly stated.
- Step 3: From the date of receiving a complete and legal application, the file-receiving officer examines, evaluates the application, and conducts consultative procedures with relevant agencies, compiles feedback, and requests additional documents (if any).
- Step 4: The Ministry or equivalent agency that manages the main field of operation of the proposed association reviews and decides to recognize the steering committee for establishing the association. If not approved, a written response explaining the reason must be provided.
(2) Method of Submission
Applications can be submitted directly to the Ministry or equivalent agency that manages the primary field of operation of the proposed association; via public postal service or through the online public service portal. The application must have an acknowledgement of receipt by the competent authority. If sent via public postal service, the receipt date is determined by the postmark date.
(3) Required Documentation
- Application form for recognizing the steering committee for establishing the association (as per the form);
- List and brief background (original) of the proposed members of the steering committee for establishing the association and related documents (original).
- Personal resume (as per the form) and Judicial record number 1 (original) of the steering committee members for establishing the association no older than 6 months from the date of application submission; if members are officials and public employees, a written approval to join the steering committee from a competent authority as per personnel management regulations is required instead of the Judicial record number 1;
- Consent form from the competent authority as per personnel management regulations for officials and public employees joining the steering committee (original).
(4) Processing Time
30 working days from the date when the competent authority receives a complete and legal application for recognizing the steering committee for establishing the association.
(5) Requirements and Conditions for Administrative Procedures
- The head of the steering committee must possess good political and ethical qualities, have experience, credibility, expertise in the field of the proposed association, and reside permanently in Vietnam;
Members of the steering committee who are officials and public employees must have written consent to join the steering committee by a competent authority according to personnel management regulations.
Steering committee members who are organizations or Vietnamese citizens must be passionate, responsible, active in, or related to the proposed field of the association. Members must meet the following conditions:
+ For organizations:
Legally established, have statutes or documents defining the functions and duties of the organization; an application to join the steering committee; a resolution by the leadership collective or a decision by the authorized head to participate in the steering committee and nominate a representative. The nominated representative must be a Vietnamese citizen with full civil capacity, good health, and no criminal record;
+ For citizens: an application to join the steering committee, full civil capacity, good health, and no criminal record.
- For associations with national or inter-provincial scope, the steering committee must have at least 10 members.
- The steering committee dissolves itself after organizing a congress to elect the association's executive board.
