Procedure for Receiving Minors into Child Assistance Facilities

This content is specifically stipulated in Circular 55/2015/TT-BLDTBXH which provides guidelines on the reception, management, and education of juveniles without stable residences who are subject to educational measures at communes, wards, and commune-level towns at child support facilities.

According to the provisions of Circular 55/2015/TT-BLDTBXH, the reception of minors subject to educational measures at commune, ward, or commune-level town at child support facilities is carried out as follows:

- The head of the commune-level police department prepares a dossier and submits it to the Chairman of the commune-level People's Committee for review and decision on the application of educational measures at the commune, ward, or commune-level town for the subject;- The subject or the guardian submits a request directly to the competent commune-level People's Committee to decide on the application of educational measures at the commune, ward, or commune-level town for cases specified in Point b, Clause 1, Article 2 of Circular 55;- Upon receiving 01 dossier from the head of the commune-level police department and the application from the subject or guardian, within 01 working day, the Chairman of the commune-level People's Committee sends a written request to the Department of Labor, Invalids and Social Affairs to carry out procedures for receiving the subject into the facility;- Within 01 working day from the receipt of the complete dossier, the Department of Labor, Invalids and Social Affairs is responsible for appraising the dossier and submitting it to the Chairman of the district-level People's Committee for a decision on the reception of the subject into the facility within their management authority, or sends a written request to the Department of Labor, Invalids, and Social Affairs for a decision on the subject entering the facility;- Within 01 working day from the receipt of the complete dossier, the Director of the Department of Labor, Invalids and Social Affairs decides on the reception of the subject into the facility within their management authority;- ...
