Reappointment Procedure for Public Employees Holding Management Positions (Illustration)
To be specific, Article 51 of Decree 115/2020/ND-CP stipulates the procedure for reappointing public employees holding management positions as follows:
- No later than 90 days before the end of the appointment term, the competent appointment authority must issue a notice to carry out the reappointment review process for the public employee.
- The public employee must submit a self-assessment report evaluating the performance of their duties during the term and send it to the head of the competent appointment authority.
- Organize a conference of key officials to solicit opinions on reappointment:
- Composition: Performed as stipulated in step 4 of the appointment process for public employees in management positions.- Sequence of Execution: The public employee under consideration for reappointment reports self-assessment and evaluation of duty performance during the term; the conference participants provide feedback and vote in confidence through a secret ballot regarding the public employee under consideration for reappointment.- The conference minutes and ballot results are sent to the head of the competent appointment authority. The ballot results are not announced at this conference.
- The collective leadership of the unit discusses and votes on the personnel.
Regarding the composition: Performed as stipulated in step 5 of the appointment process for public employees in management positions.
Regarding the sequence of execution:
- Analyze the ballot results at the key officials' conference. The public employee proposed for reappointment must achieve over 50% approval from the total number of attendees at the key officials' conference;- Verify and conclude on any newly arising issues (if any);- Seek written opinions from the executive committee of the party committee or the unit's party committee (where there is no executive committee) about the personnel proposed for reappointment;- The collective leadership discusses, evaluates, and votes on the personnel by secret ballot. The personnel proposed for reappointment must achieve over 50% approval from the total collective leadership members; if the personnel achieves exactly 50%, the decision is made by the head of the unit; concurrently reporting all differing opinions to the competent authority for review and decision.- The head of the public service provider issues the reappointment decision according to their authority or submits it to the competent authority for review and decision.
