The Minister of Planning and Investment of Vietnam has issued Decision No. 1351/QD-BKHDT dated June 14, 2024, announcing new, amended, annulled, cancelled administrative procedures, and administrative procedures subject to public cancellations in the field of bidding within the scope of management of the Ministry of Planning and Investment of Vietnam.

Procedure for participating in the National E-Procurement System for Contractors and Investors in Vietnam (Latest)

From June 14, 2024, the procedure for participating in the National E-Procurement System for contractors and investors in Vietnam is regulated as follows:

(1) Steps to be followed:

- Step 1: Registration of contractor/investor information

+ Contractors and investors register their unit information on the National E-Procurement System at https://muasamcong.mpi.gov.vn (the System);

+ Contractors and investors print the registration form from the System and submit it accompanied by the registration dossier as prescribed in point c, clause 1, section 1 on the System.

- Step 2: Receive the processed registration dossier results and the organization's login information via email.

(2) Method of implementation: Contractors and investors input the registration information generated on the System and submit the registration dossier on the System according to the User Guide.

(3) Components of the dossier:

- Organizations submit a registration dossier on the System consisting of the following documents:

(i) The registration form generated on the System, signed and stamped (if available) by the legal representative of the organization;

(ii) Power of attorney (if available);

(iii) Decision on establishment or Business registration certificate or Household business registration certificate or Certificate of cooperative, cooperative union, or cooperative group registration or other equivalent documents in case the organization is not listed in the national business registration information system;

- Individuals submit a registration dossier on the System consisting of the following documents:

(i) The registration form generated on the System, signed by the individual registrant;

(ii) A photocopy of the passport or an equivalent document for foreigners.

(4) Number of dossiers: 01 set.

(5) Time limit for resolution: 02 working days from the day of receiving a complete registration dossier.

(6) Implementing agency: National Bidding Network Center - Department of Bidding Management - Ministry of Planning and Investment.

(7) Subjects performing administrative procedures: Organizations, individuals related to bidding activities.

(8) Result of administrative procedure implementation: Contractors and investors are listed in the approved database of contractors and investors on the System and are granted an Account to participate in the System.

(9) Charges: None

(10) Form and declaration templates: Follow the Models provided in the webform on the System and guided during the registration process.

(11) Requirements and conditions for performing procedures: None

(12) Legal basis of administrative procedures:

- Law on Bidding 2023;

- Decree No. 24/2024/ND-CP dated February 27, 2024, detailing some articles and measures for the implementation of Law on Bidding 2023 on contractor selection.

More details can be found in Decision No. 1351/QD-BKHDT which comes into force in Vietnam from June 14, 2024.

The following Decisions: No. 244/QD-BKHDT of 2019 announcing the list of amended, supplemented, abolished administrative procedures in the field of bidding under the management function of the Ministry of Planning and Investment; No. 1901/QD-BKHDT of 2019 announcing the list of additional administrative procedures in the field of bidding under the management function of the Ministry of Planning and Investment; Decision No. 1794/QD-BKHDT of 2022; Decision No. 321/QD-BKHDT of 2024 announcing new administrative procedures in the field of contractor selection, investor selection under the management function of the Ministry of Planning and Investment become invalid from the date Decision No. 1351/QD-BKHDT becomes effective.
