Procedure for Land Recovery Due to Legal Violations at Airports

This is an important content stipulated in Circular 17/2016/TT-BGTVT detailing the management and operation of airports and airfields.

The recovery of land due to legal violations at airports and airfields is carried out according to the following procedures:

- In cases where legal violations necessitate land recovery, upon the expiration of the statute of limitations for administrative penalty, the authorized penalizing officer is responsible for drafting a report on the administrative violation to serve as the basis for the decision to recover the land.- Within no more than 07 days from the date of drafting the violation report, the authority responsible for inspection and examination must send the violation report to the Airport Authority.- Within no more than 05 working days from the date of receiving the violation report, the Airport Authority is responsible for verifying, and conducting on-site verification if necessary, and issuing the decision to recover the land.- Within no more than 05 working days from the date of issuing the land recovery decision, the Airport Authority is responsible for sending the land recovery decision, and the excerpt or excerpted cadastral map of the recovered land area to the Civil Aviation Authority of Vietnam and the Land Registration Office for updating and amending the cadastral records and land database.
