Procedure for Issuing, Reissuing, and Revoking Airport Business Licenses

On September 19, 2018, the Ministry of Transport issued Circular 51/2018/TT-BGTVT, specifically stipulating the procedures for issuing, reissuing, and revoking Airport Business Licenses.

Procedures for Issuing Aviation Business Operating License

Specifically:, Circular 51 stipulates that individuals or organizations requesting the issuance of an Aviation Business Operating License must submit 01 dossier directly, via postal services, or by other appropriate means to the Civil Aviation Authority of Vietnam and are responsible for the accuracy and truthfulness of the information in the dossier.

The dossier includes:

- Application for the Issuance of a License- Copy of the business registration certificate- Copy of documents proving the organizational structure and personnel with proper licenses and certificates meeting the professional requirements for airport operation as prescribed by civil aviation law- Original document verifying capital- Plan for equipment, devices, and other necessary conditions to ensure aviation safety and security

Within 10 days from the date of receiving the complete dossier as per regulations, the Civil Aviation Authority of Vietnam will organize the appraisal and issue the Aviation Business Operating License. In case the License is not issued, a written response must be sent to the applicant stating the reasons.

In case the dossier is invalid, within 03 working days from the date of receiving the dossier, the Civil Aviation Authority of Vietnam must issue a written response, guiding the applicant to complete the dossier as per regulations.

Procedures for Reissuing Aviation Business Operating License

Circular 51/2018 stipulates: the Aviation Business Operating License is reissued in case of loss, damage, or change in the content of the license.

Individuals or organizations must send 01 dossier requesting the reissuance of the Aviation Business Operating License directly, via postal services, or by other appropriate means to the Civil Aviation Authority of Vietnam and are responsible for the accuracy and truthfulness of the information in the dossier when requesting the reissuance of the Aviation Business Operating License. The dossier includes:

- Written request for reissuance of the License- Relevant documents in case of changes in the content of the License (if any)

For licenses reissued due to changes in content: Within 05 working days from the date of receiving the complete dossier as per regulations, the Civil Aviation Authority of Vietnam will reissue the Aviation Business Operating License; in case the License is not reissued, a written response must be sent to the applicant stating the reasons.

For licenses reissued due to loss or damage: Within 03 working days from the date of receiving the request, the Civil Aviation Authority of Vietnam must consider and decide on reissuing the License or notify the applicant in writing of the reason for refusal.

Cancellation of Aviation Business Operating License

As stipulated, the Aviation Business Operating License will be canceled in the following cases:

- Providing untruthful information during the application process- Failing to maintain the minimum continuous capital during operation- Serious violations of laws on security and defense- Termination of operations as prescribed by law or at the request of the enterprise- Serious violations of regulations on ensuring aviation security, safety, business conditions, service prices, fire prevention and firefighting, environmental protection- Failing to commence airport operations within 12 months from the date of license issuance

The Civil Aviation Authority of Vietnam issues a decision to cancel the effect of the License, stating the reasons and the time of cancellation. The aviation business enterprise must immediately cease airport business activities as per the issued decision.

The Civil Aviation Authority of Vietnam must notify the issuance, reissuance, and cancellation of the Aviation Business Operating License to the Aviation Authority for inspection and supervision purposes.

Circular 51/2018/TT-BGTVT is effective from November 05, 2018.
