Procedure for Issuance of Licenses for Gold Production and Trading Activities

When the legal conditions for production, business activities, gold importation, etc., have been met, in order to commence operations, the enterprise needs to submit a complete dossier as prescribed to the competent state authority for consideration and issuance of an operating license in accordance with the legal procedures and processes.

According to the provisions of Article 16 Circular 16/2012/TT-NHNN, Clause 15 Article 1 Circular 38/2015/TT-NHNN, the procedures for granting a Certificate of eligibility for producing gold jewelry and fine arts, and a License for temporary import of raw gold for re-exporting products are as follows:

Step 1: Submit the dossier

Enterprises (DN) wishing to produce gold jewelry and fine arts, and enterprises wishing to import raw gold for processing gold jewelry and fine arts for export, shall directly submit or send by post 01 dossier as stipulated in Articles 8 and 11 of Circular 16/2012/TT-NHNN to the State Bank (NHNN) branch in the province or city where the enterprise's head office is located.

Step 2: Grant Certificate

- Regarding the procedure for granting a Certificate of eligibility for producing gold jewelry and fine arts:

Within 30 working days from the date of receiving a complete and valid dossier, based on the regulations on conditions, dossiers, and procedures in Decree 24/2012/ND-CP, Circular 16/2012/TT-NHNN and the actual inspection results of the facilities and equipment for producing gold jewelry and fine arts of the enterprise, the Director of the NHNN branch in the province or city shall grant or refuse to grant (stating the reason) the Certificate of eligibility for producing gold jewelry and fine arts.

- Regarding the procedure for granting a License for temporary import of raw gold for re-exporting products:

Based on the regulations on conditions, dossiers, and procedures in Decree 24/2012/ND-CP and in Circular 16/2012/TT-NHNN, within 30 working days from the date of receiving a complete and valid dossier, the Director of the NHNN branch in the province or city shall grant or refuse to grant (stating the reason) the License for temporary import of raw gold for re-exporting products. The validity period of the License for temporary import of raw gold for re-exporting products is determined based on the gold jewelry and fine arts processing contract and is a maximum of 12 months from the date of issuance.

Additionally, the procedures for granting a Business license for buying and selling gold bullion; a License for exporting raw gold; a License for importing raw gold for enterprises with foreign investment, enterprises investing abroad in gold mining; and a License for importing raw gold for producing gold jewelry and fine arts are detailed in Articles 15 and 17 Circular 16/2012/TT-NHNN and Clauses 13 and 16 Article 1 Circular 38/2015/TT-NHNN.
