Procedure for Issuance of Certificate of Eligibility for Casino Business

Conditions of Implementation:

- Conditions for being granted the Certificate of Eligibility for Casino Business include:- Being granted an Investment Registration Certificate or an Investment Policy Decision by a competent state management agency, which includes casino business activities;- The enterprise has completed the disbursement of at least 50% of the total registered investment capital as indicated in the Investment Registration Certificate or Investment Policy Decision;- Having an area to set up the Casino Business Point that meets the conditions specified in Clause 2, Article 5 of Decree 03/2017/ND-CP;- Having a manager or operator of the Casino Business Point with at least a university degree, a minimum of 01 year of experience in managing casino business activities, and not being subject to the prohibition from establishing or managing an enterprise under the law;- Having a business operation plan as prescribed in Clause 6, Article 25 of Decree 03/2017/ND-CP.- Each investment project in a service, tourism, and entertainment complex with a casino will only be considered for one Certificate of Eligibility for Casino Business, and the Certificate is only granted to the enterprise registered to implement the investment project specified in the Investment Registration Certificate or Investment Policy Decision.- Before organizing casino business activities, the enterprise must ensure compliance with security and order conditions applicable to conditional business sectors as stipulated by law.

Step 1: Prepare Dossier

The enterprise needs to prepare 06 sets of dossiers with the following components:

- Application for Certificate of Eligibility for Casino Business.- Certified copy of the Investment Registration Certificate or Investment Policy Decision, which includes casino business activities, and any adjusted Investment Registration Certificate or Investment Policy Decisions (if any) granted by a competent state management agency according to investment law or a non-certified copy presented with the original for comparison.- Documents demonstrating the enterprise has completed the investment capital disbursement as stipulated in point b, Clause 1, Article 24 of Decree 03/2017/ND-CP.- Diagram of the location for setting up the Casino Business Point.- Draft internal management regulations, organization of the Internal Control Department, internal regulations on anti-money laundering, dispute resolution regulations, and game rules.- Casino business operation plan, including: Information about the enterprise, progress of the investment project, proposed duration for casino business, estimated number of gaming machines, gaming tables, types of business rewarded games, business efficiency assessment, projected foreign currency income and expenses, security, order, and social safety measures for the Casino Business Point, and implementation plan.- List, judicial record, certified copies of qualifications from competent state agencies proving the professional and managerial capabilities of the Casino Business Point manager or operator, or non-certified copies presented with the original for comparison.

Step 2: Submit Dossier

- The enterprise submits one set of the application for the Certificate of Eligibility for Casino Business to the Ministry of Finance for checking the completeness and validity of the dossier.- Within 15 days from the date of receipt of the dossier, the Ministry of Finance informs the enterprise about the completeness and validity of the dossier and requests additional documents (if any), and the enterprise then submits 06 official sets of dossiers for assessment.- Within 15 days from the date of receipt of a valid dossier, the Ministry of Finance sends the dossier to consult related agencies, including: Ministry of Planning and Investment, Ministry of Public Security, Ministry of Culture, Sports, and Tourism, State Bank of Vietnam, and the provincial People’s Committee where the enterprise applies for organizing casino business activities;- Within 15 days from the date of receipt of the consultation dossier, the consulted agency must provide written feedback to the Ministry of Finance and be responsible for the contents of the consultation;- After receiving feedback from the relevant ministries and central authorities as stipulated in point a, Clause 3 of this Article, the Ministry of Finance aggregates the opinions and considers deciding on the issuance or non-issuance of the Certificate of Eligibility for Casino Business.- Within 60 days from the date of receipt of a valid dossier, the Ministry of Finance considers issuing the Certificate of Eligibility for Casino Business. In case of refusal, the Ministry of Finance notifies the enterprise in writing, clearly stating the reasons for the refusal.

Fees: None

Result of Implementation: The Ministry of Finance issues the Certificate of Eligibility for Casino Business and provides written notification, stating the reasons in case of refusal.
