Procedure for Issuance of Certificate of Bomb and Mine Detection, Surveying, and Clearance

Recently, the Minister of National Defense signed and issued Circular 195/2019/TT-BQP detailing certain articles and measures for the implementation of Decree 18/2019/ND-CP dated February 1, 2019, by the Government of Vietnam concerning the management and execution of post-war bomb and explosive remnants clearance activities.

According to regulations, there are 02 types of certificates for post-war investigation, survey, and clearance of mines and explosive remnants of war:

- Organizational Competency Certificate: This certificate is granted to organizations and units involved in investigation, survey, and clearance of mines and explosive remnants of war (ERW) that meet technical and safety conditions as prescribed by law, in accordance with national and international standards, to conduct consulting, supervision, and investigation, survey, and clearance of mines and ERW.

- Individual Competency Certificate: This certificate is granted to individuals who have completed training programs in the field of investigation, survey, and clearance of mines and ERW. This includes team leader certificates, technician certificates, supervisor certificates, and other specialized training certificates.

Regarding the procedure for issuing post-war investigation, survey, and clearance of mines and ERW certificates, Clause 3, Article 28 Circular 195/2019/TT-BQP stipulates as follows:

- The Command of Engineers presides, in cooperation with the Operations Directorate of the General Staff and related agencies, to inspect and evaluate capacity, report to the Ministry of National Defense to issue competency certificates to organizations and units engaged in investigation, survey, and clearance of mines and ERW according to the procedures specified in the Vietnamese Standards TCVN-10299-2: Assessment and Recognition of Organizations Performing Mine and ERW Clearance;

- VNMAC presides, in cooperation with related agencies, to inspect and evaluate capacities, report to the Command of Engineers to submit to the Ministry of National Defense to issue competency certificates to international organizations operating in the field of investigation, survey, and clearance of mines and ERW in Vietnam according to IMAS standards.

The sample certificates for team leaders, supervisors, and technicians involved in the investigation, survey, and clearance of mines and ERW follow Form 02, 03, 04 of Appendix V issued with Circular 195/2019/TT-BQP. Specialized training certificates issued by domestic training and educational institutions follow the forms prescribed by the respective training institutions. Foreign language training certificates and specialized certificates granted by international organizations must be accompanied by a certified translation.

Additionally, the authority for issuing certificates for investigation, survey, and clearance of mines and ERW is defined in this Circular as follows:

- The Ministry of National Defense issues competency certificates to organizations and units engaged in investigation, survey, and clearance of mines and ERW according to Form 01 of Appendix V issued with this Circular;

- The Command of Engineers trains and issues certificates for team leaders, technicians, and supervisors for the investigation, survey, and clearance of mines and ERW to Vietnamese citizens;

- VNMAC trains and issues certificates for team leaders, technicians, supervisors, and specialized certificates for the investigation, survey, and clearance of mines and ERW to Vietnamese expatriates, foreigners working in Vietnam; trains and issues Level 4 certificates to technicians for the investigation, survey, and clearance of mines and ERW to Vietnamese citizens; trains and issues quality management certificates for investigation, survey, and clearance of mines and ERW.
