Procedure for handling resignation of officials in the military in Vietnam

The Ministry of National Defense recently issued Circular 148/2010/TT-BQP providing guidelines for the implementation of resignation policies for officials in the Vietnam People's Army, which include provisions on the procedures for handling the resignation of officials in the army.

In Article 4 of Circular 148/2010/TT-BQP, the procedures for resolving resignations for officials in the military are regulated as follows:

- Procedure for resolving resignations: To be carried out in accordance with the provisions of Article 4 of the Decree 46/2010/ND-CP.

- Dossier for resolving severance allowance policies for each case includes:

- Resignation application: 1 copy (for subjects requesting resignation);

- Resignation decision from the competent authority: 5 copies (issued and established by the personnel management agency, submitted to the unit commander for approval; individual 2 copies, Finance agency 1 copy, Social insurance agency 1 copy, Personnel management agency 1 copy);

- Decision on the implementation of severance allowance policies: 4 copies (Appendix attached to this Circular; individual 1 copy, Finance agency 1 copy, Policy agency 1 copy, Personnel management agency 1 copy).

The personnel management agency (Personnel, Military Affairs) within the authority of managing officials is responsible for creating the Decision on the implementation of severance allowance policies; the equivalent Policy agency leads the appraisal, submits it to the unit commander for approval, and consolidates reports to the higher-level Policy agency.

The authority to make decisions and assign the management of officials is implemented according to the regulations of the Communist Party's Central Military Commission and the Ministry of National Defense.
