Procedure for Conducting Confidence Votes at the People's Council

According to the recent Guidance 321/HD-UBTVQH14 of the Standing Committee of the National Assembly, the process of taking the vote of confidence at the People's Councils at all levels for the 2016-2021 term shall be carried out as follows:

(1) The person subject to the vote of confidence shall submit a written report (according to the form in the Appendix of Resolution 85/2014/QH13) to the Standing Committee of the People's Council no later than 30 days before the opening date of the People's Council session;

(2) The Standing Committee of the People's Council shall send the report of the person subject to the vote of confidence and the report summarizing the opinions and recommendations of the voters related to the person subject to the vote of confidence by the same level's Vietnam Fatherland Front Committee (if any) to the People's Council deputies no later than 20 days before the opening date of the People's Council session.

(3) In case the People's Council deputies see the need to clarify issues related to the person subject to the vote of confidence, no later than 15 days before the opening date of the session to conduct the vote of confidence, the People's Council deputies have the right to request the Standing Committee of the People’s Council to ask the competent authority for verification and respond in writing.

(4) No later than 10 days before the opening date of the session, the People's Council deputies can send documents to the Standing Committee of the People's Council and the person subject to the vote of confidence to request the person subject to the vote of confidence to clarify issues related to the basis for voting. The person subject to the vote of confidence is responsible for responding in writing to the Standing Committee of the People's Council and the People's Council deputies who made the request before the voting date.

(5) At the session, the Standing Committee of the People's Council submits to the People's Council the decision on the list of persons subject to the vote of confidence.

Before conducting the vote of confidence, the People's Council shall discuss among the Parliamentary Delegation groups about issues related to the vote of confidence. The Standing Committee of the People's Council shall report to the People's Council the outcome of the group discussions.

(6) The People’s Council establishes a Vote Counting Committee.

(7) The People's Council conducts the vote of confidence through secret ballot. The ballot clearly states the full name, position of the person subject to the vote of confidence, and the rating levels: “high confidence,” “confidence,” “low confidence.”

(8) The Vote Counting Committee announces the vote counting results.

(9) The People's Council reviews and passes a Resolution to confirm the results of the vote of confidence as proposed by the Standing Committee of the People's Council.

For the People's Council at the commune level, since no Parliamentary Delegation groups are established, before conducting the vote of confidence, the Standing Committee of the commune-level People's Council decides on the division into groups for the People's Council deputies to exchange and discuss issues related to the vote of confidence.
