Recently, the Government of Vietnam has signed and promulgated Decree 90/2014/ND-CP regarding the "Ho Chi Minh Award" and the "State Award" for literature and arts.
In Article 12 of Decree 90/2014/ND-CP, the process for awarding the “Ho Chi Minh Prize” and the “State Prize” for literature and arts is prescribed to be carried out through three levels of Councils as follows:

- The grassroots-level Council in the province or city directly under the Central Government (hereinafter referred to as the provincial level) established by the Chairman of the Provincial People’s Committee or at the Central Professional Literature and Arts Association established by the Chairman of the Central Professional Literature and Arts Association.
- The provincial-level Council in the province or city directly under the Central Government (hereinafter referred to as the provincial level) established by the Chairman of the Provincial People’s Committee or at the Central Professional Literature and Arts Association established by the Chairman of the Central Professional Literature and Arts Association.
- The State-level Council established by the Prime Minister of the Government of Vietnam upon the proposal of the Minister of Culture, Sports, and Tourism.
The “Ho Chi Minh Prize” and the “State Prize” for literature and arts are awarded and announced every 5 years, on the occasion of the National Day on September 2.
The Councils are established for each award session and dissolve after completing their tasks. Authors with works or projects proposed for the “Ho Chi Minh Prize” or the “State Prize” for literature and arts do not participate in any level of the Councils.
This Decree stipulates that authors register their literary and artistic works or projects to be proposed for the “Ho Chi Minh Prize” or the “State Prize” by submitting one set of documents as specified in Clause 1, Article 14, directly or via postal service to the Department of Culture, Sports, and Tourism or the Central Literature and Arts Association if the author is a member, within the timeframe specified in the Plan. In the case where the author has passed away, the legal representative of the author or the Executive Committee of the Literature and Arts Association, where the author was a member, after agreeing with the legal representative of the author, shall register the literary and artistic works or projects to be proposed for the “Ho Chi Minh Prize” or the “State Prize” as per regulations.
