Vietnamese citizens and foreigners residing in Vietnam who wish to apply for a judicial record certificate should follow the procedure and steps as follows:
Application Documents Include:
- Declaration Requesting Issuance of Criminal Record Certificate according to the prescribed form (Form No. 03/2013/TT-LLTP; Form No. 04/2013/TT-LLTP).- A copy of the Identity Card or Passport of the person to whom the Criminal Record Certificate is to be issued; a copy of the Household Registration Book, Temporary Residence Book, Certificate of Permanent or Temporary Residence of the person to whom the Criminal Record Certificate is to be issued.
(In case of submitting photocopies, the original must be presented for comparison. If there is no original for comparison, notarized copies must be submitted in accordance with legal regulations);- Authorization Letter in the case of authorizing another person to carry out the procedure for requesting the issuance of Criminal Record Certificate No. 1. If the authorized person is the parent, spouse, or child of the authorizing person, no authorization letter is required.
The Authorization Letter must be notarized or authenticated.
An individual requesting the issuance of Criminal Record Certificate No. 2 cannot authorize another person to carry out the procedure for requesting the Criminal Record Certificate.- A copy of the Identity Card or Passport of the authorized person (in case of authorizing to request the issuance of Criminal Record Certificate No. 1).
Fee: 200,000 VND/Certificate
- For students, persons with meritorious services to the revolution, and relatives of martyrs: 100,000 VND/each/person.- In case the person requesting the Criminal Record Certificate requests more than 2 certificates in one application, starting from the third certificate onwards, the Criminal Record Certificate issuing agency shall collect an additional 3,000 VND/Certificate.- The fee for the issuance of Criminal Record Certificates is exempted for those belonging to poor households and residing in especially difficult communes according to the law.
Individuals requesting the issuance of the Criminal Record Certificate who are subject to fee exemption or reduction must provide documents to prove it.
Implementing Agency: Department of Justice
Procedure:
- Vietnamese citizens submit their application at the Department of Justice where they reside; if there is no permanent residence, then at the Department of Justice where they temporarily reside; if residing abroad, then at the Department of Justice where they resided before leaving the country.
Foreigners residing in Vietnam shall submit at the Department of Justice where they reside.- The Department of Justice processes and issues the Criminal Record Certificate within 10 days from the date of receipt of the valid request. In cases where the person requesting the Criminal Record Certificate is a Vietnamese citizen who has resided in multiple places or has resided abroad, a foreigner, or cases requiring verification of automatic criminal record clearance eligibility, the time limit is not more than 15 days.
