Regarding this issue, LawNet would like to answer as follows:

1. Priorities when taking the public employee recruitment exam in Vietnam: What are the conditions and score calculation?

According to Article 6 of Decree 115/2020/ND-CP (amended in Decree 85/2023/ND-CP), subjects and priority scores in the entrance examination or admission are as follows:

- Heroes of the Armed Forces, Labor Heroes, war invalids, policy beneficiaries such as war invalids, and class B war invalids: 7.5 points are added to the round 2 score results;

- Ethnic minorities, military officers, police officers, serving professional soldiers, people doing cipher work, changing branches, students graduating from reserve officer training, graduating from training for commanders of commune-level military commands in the grassroots military sector who are awarded the rank of reserve officers and have registered for the rank of reserve officers, children of martyrs, children of war invalids, children of sick soldiers, children of policy beneficiaries such as war invalids, children of category B war invalids, biological children of resistance activists exposed to toxic chemicals, children of Armed Forces Heroes, Children of Labor Heroes: 5 points will be added to the results of round 2;

- People who complete military service, people's police service, and youth volunteer team members: 2.5 points are added to the round 2 score results.

- Trade union officials who grew up from the grassroots in the labor movement: 1.5 points are added to the results of round 2.

Note: In cases where the candidate taking the exam or admission test belongs to multiple priority categories according to the above regulations, only the highest priority score will be added to the round 2 score results.

Thus, depending on each different subject, contestants will be given priority points with the highest priority subject according to the regulations mentioned above.

2. When there are many people with the same score: Who gets recruitment priority in Vietnam?

According to Article 10 of Decree 115/2020/ND-CP (amended in Decree 85/2023/ND-CP), determining successful candidates in the public employee recruitment exam is as follows:

- Applicants who pass the public employee recruitment exam must meet the following conditions:

(i) Have test scores in round 2 of 50 points or more.

(ii) Have a higher number of points in round 2 plus priority points specified in section 1 (if any) taken in order of points from high to low in the recruitment criteria of the job position.

- In case there are 02 or more people whose total points calculated as prescribed in point (ii) are equal to the final target of the job position to be filled, the successful candidate is the person who achieves a higher score in the general knowledge test in round 1 (if any).

In case it is still not possible to determine, the head of the recruitment agency shall decide on the successful candidate.

- In case you register for 02 wishes but are not accepted in choice 1, you will be considered for choice 2 if the job position registered in choice 2 still has a recruitment quota after considering all wishes 1, including the wishes of people with lower admission results as prescribed in Clause 4, Article 18 of Decree 85/2023/ND-CP.

In case there are 02 or more people with the same score in the 2nd choice, the successful candidate will be determined according to the regulations above.

In case the job position still has a recruitment quota after 02 applications have been considered, based on the exam results, the exam council reports to the head of the agency with recruitment authority to decide whether to recruit the person whose recruitment result is immediately lower than the recruitment result of the successful candidate for a job position at another unit but has the same standards and conditions as the standards and conditions of the job position at the unit that still has recruitment quotas, the same exam council, the same exam or writing format (round 2), and the same exam questions. The person recruited in this case must meet the provisions in point (i).

For job positions with no applicants, the head of the recruitment agency decides on recruitment according to this regulation.

Thus, if there are 02 or more people whose total points calculated as prescribed in point (ii) are equal in the final criterion of the job position to be filled, the successful candidate is the person who achieves a higher score in the general knowledge test in round 1 (if any).

In case it is still not possible to determine, the head of the recruitment agency shall decide on the successful candidate.
