On December 27, 2024, the Government of Vietnam promulgated Decree 169/2024/ND-CP providing guidance on the organization and activities of the People's Commitees of wards of Hanoi.

Principles of operation for the People's Commitees of wards of Hanoi from January 1, 2025

Article 4 Decree 169/2024/ND-CP mandates that the activities of the People's Commitees of wards of Hanoi must ensure the following principles:

- The People's Commitees of wards operates according to the policies of the head, ensuring the principle of democratic centralism. The Chairman of the People's Commitees of wards decides on matters within the tasks and powers of the People's Commitees of wards and the Chairman of the People's Commitees of wards and is responsible for his decisions.

- In the event of a vacancy in the position of Chairman of the People's Commitees of wards, the Chairman of the district-level town or city within the city shall decide to delegate the power of Chairman of the People's Commitees of wards until a new chairman is appointed.

- The specific tasks and powers of the People's Commitees of wards and tasks and powers assigned or delegated as stipulated in Clause 1, Article 13, and Article 14 Capital Law 2024 must be discussed collectively before the Chairman of the People's Commitees of wards decides and is responsible for his decisions.

The collective as prescribed in this clause includes: the Chairman of the People's Commitees of wards, Deputy Chairman, and other relevant officials.

- The operations of the People's Commitees of wards must satisfy public satisfaction, comply with processes, procedures, and authorized competence, conform to the law and the working regulations of the People's Commitees of wards. Administrative reform, online public service application in resolving administrative procedures for individuals and organizations in the ward, should be promoted, ensuring the People's Commitees of wards's activities are democratic, transparent, unified, uninterrupted, effective, and efficient.

- The ward police chief advises and is subject to the command and administration of the Chairman of the People's Commitees of wards in implementing the tasks of security, order, social safety, crime prevention, and other legal violations within the locality according to legal provisions.

Duties and powers of the People's Commitees of wards of Hanoi

According to Clause 1, Article 13 Capital Law 2024, the People's Commitees of wards of Hanoi has the following duties and powers:

- Implement tasks and powers of the budgetary estimate unit under the district-level town, city-affiliated city as provided by the State Budget Law.

The People's Commitees of wards Chairman decides expenditures from the unallocated funds under the provisions at Point c, Clause 3, Article 11 Capital Law 2024, and periodically reports quarterly to the district-level town or city-affiliated city to report to the People's Council at the next nearest session;

- Propose investment policies for programs and public investment projects utilizing state budget funds to the district-level town or city-affiliated city; give opinions on investment projects' policies within the authority of agencies or persons authorized by the Public Investment Law required to have the participation of the commune-level People's Council; organize the implementation of public investment programs and projects according to management decentralization;

- Propose and cooperate with authorized agencies to implement national defense, security tasks, and measures to ensure order and local safety according to management decentralization; direct the Ward Police to perform tasks of maintaining security, order, and social safety in the ward;

- Coordinate with the Vietnam Fatherland Front Committee of the same level to establish election organizing bodies and organize elections according to the law on the election of National Assembly and People's Council deputies;

- Organize and ensure the enforcement of the Constitution, laws, documents of higher state agencies in the ward; perform other tasks and powers of the People's Commitees of wards, the Chairman of the People's Commitees of wards as prescribed by law;

- Decide on matters that according to the regulations of other legislative documents must be decided by the commune-level People's Council or must be submitted to the commune-level People's Council for approval before the People's Commitees of wards decides; submit to the district-level town or city-affiliated city matters that according to other legislative documents must be approved by the commune-level People's Council before submitting to the higher state agencies for consideration and decision.

Note: The People's Commitees of wards does not have the competence to issue legislative documents.
