The 2018 Law on Anti-Corruption was passed by the National Assembly in the 6th session of the XIV National Assembly.
According to the new regulations, it is periodically required to transfer the job positions of officials who do not hold leadership or management positions and public employees within their agencies, organizations, or units to prevent corruption.
The principles of transfer are prescribed by law as follows:
- The rotation of officials holding leadership or management positions shall comply with the regulations on cadre rotation;- The transfer of job positions must ensure objectivity, reasonableness, suitability with professional expertise, and must not affect the normal activities of the agency, organization, or unit;- The transfer of job positions must be carried out according to the plan and publicly in the agency, organization, or unit;- It is prohibited to take advantage of the periodic transfer of job positions for personal gain or to suppress officials and public employees.
Note, the above principles also apply to the transfer of job positions of the following non-leadership individuals:
- Officers, professional soldiers, workers, and national defense public employees in the agencies and units under the People's Army;- Officers, non-commissioned officers, professional officers, technical non-commissioned officers, police workers in the agencies and units under the People's Police.
