Principles of Competitive Examination for Selection and Promotion of Judges

Circular 02/2016/TT-TANDTC was promulgated by the Supreme People's Court on February 03, 2016, detailing the specific principles for the selection examination and promotion examination of judges.

Circular 02 stipulates that when taking the selection exam or the promotion exam for Judges, the following principles must be observed:

- Candidates for the selection exam must meet all the conditions corresponding to the exam grade.- The selection exam and the promotion exam for Judges are conducted on a competitive basis, ensuring a strict, transparent, open, fair, and democratic process to select individuals who meet the necessary conditions and standards for appointment as primary-level Judges, intermediate-level Judges, or high-level Judges.- The selection exam and the promotion exam for Judges are organized separately for each candidate group as specified in Article 2 of this Regulation or jointly for several candidate groups. The decision to conduct separate or joint exams is made by the Council for the selection and promotion of primary-level Judges, intermediate-level Judges, and high-level Judges.- The selection exam and the promotion exam for Judges are organized at least twice a year. If necessary, the Chairman of the Council for the selection and promotion of primary-level Judges, intermediate-level Judges, and high-level Judges may decide to add an additional exam session.- The exam time, location, content, and format are decided by the Council for the selection and promotion of primary-level Judges, intermediate-level Judges, and high-level Judges.- The Council for the selection and promotion of primary-level Judges, intermediate-level Judges, and high-level Judges authorizes the Judicial Academy to organize the exam. The Judicial Academy forms an Examination Council and subcommittees to conduct the exam according to the authorization.- The organization of the selection exam and the promotion exam for Judges is carried out according to the Law on the Organization of People's Courts, the Law on Cadres and Officials, guiding documents, and the provisions of this Regulation.
