Principles of arranging for rental and furnishing official houses from August 1, 2024

Recently, the Prime Minister of Vietnam issued a document stipulating the standards for the area and the norms for furnishings in official houses. This document includes regulations on principles for the allocation, leasing, and furnishing of official houses.

On July 24, 2024, the Prime Minister of Vietnam issued Decision 11/2024/QD-TTg on the standards for area and equipment for furnishing official houses.

1. Principles for arranging lease and interior equipment for official houses in Vietnam from August 1, 2024

The principles for arranging lease and interior equipment for official houses in Vietnam from August 1, 2024 include:

(1) Principles for arranging lease of official houses

- The arrangement for renting official houses must ensure the correct target group, and sufficient conditions as prescribed in Article 45 Law on Housing 2023;

- For official houses owned by the Communist Party of Vietnam (managed by the Central Office of the Communist Party), the implementation follows the law and the regulations of the competent agencies of the Communist Party;

- In the case that one person simultaneously holds multiple positions eligible for arranging rental of official houses, the arrangement follows the highest position;

- In case there are not enough types of official houses to allocate according to standards, based on the current state-owned housing fund, the agency representing the owner considers and decides the appropriate arrangement;

- For subjects specified in point g, clause 1, Article 45 Law on Housing 2023, the Prime Minister of Vietnam decides on the arrangement for rental, the area standards, and the equipment standards for furnishing official houses upon the proposal of the Ministry of Construction;

- The rental period for official houses corresponds to the term of the position the lessee is transferred, rotated, seconded, appointed, or extended, ensuring eligibility and conditions for rental of official houses under the Housing Law.

(2) Principles for furnishing official houses

- The funding for investment in building official houses and furnishing them with equipment comes from state budget funds, including central and local budgets;

- Furnished equipment attached to official houses, included in the investment cost for building official houses or purchasing commercial houses to use as official houses, includes: Air conditioning systems; synchronized kitchen cabinets (including kitchen cabinet, sink, faucet, stovetop, and hood); water heater; synchronized sanitary equipment;

- Furnished equipment not attached to official houses includes: Living room: 01 set of tables and chairs, and 01 TV cabinet; kitchen: 01 dining table set and chairs, 01 refrigerator; bedroom: 01 wardrobe, 01 bed, 01 mattress; 01 work table set and chairs; 01 washing machine;

- Furnished equipment for state-owned villas, adjoining houses, and apartments specified in points (1), (2), and (3) of section 2 shall comply with the provisions of points b and c of clause 2 Decision 11/2024/QD-TTg;

- For furnished equipment in official houses specified in point (4) of section 2, including 01 set of tables and chairs, 01 refrigerator, 01 wardrobe, 01 fan, 01 bed, and 01 mattress;

- The choice of furnishing equipment must be suitable for the function, area, and space of each room in the state-owned house to ensure savings and efficiency under regulations; for official houses purchased with pre-existing furnishings, replacements are not allowed, only supplements for missing or incomplete equipment according to design compliant with points b, c, and d of clause 2 Article 2 Decision 11/2024/QD-TTg;

- For official houses invested and built previously that lack complete furnishing, the managing agency of official houses reports to the competent authority for additional furnishing under regulations;

- Furnishing of official houses must be budgeted, planned for procurement to ensure savings and efficiency and executed and settled under the current law;

- In case of arranging rental of official houses with pre-used furnishings that are not yet fully depreciated or fully depreciated but still usable, the use of such furnishings should continue.

(3) Principles for planning to procure replacement furnishings

In case the furnishings in official houses have been fully depreciated and are not able to continue being used, the planning for procurement of replacement furnishings should follow:

- For procurement of furnishings for official houses of central agencies (except the Ministry of National Defense and the Ministry of Public Security): The Ministry of Construction plans the procurement, agrees with the Ministry of Finance, and reports to the Prime Minister of Vietnam for consideration and decision;

- For procurement of furnishings for official houses of the Ministry of National Defense and the Ministry of Public Security: The Ministry of National Defense and the Ministry of Public Security plan the procurement, agrees with the Ministry of Construction and the Ministry of Finance, and reports to the Prime Minister of Vietnam for consideration and decision;

- For procurement of furnishings for official houses at the local level, the Department of Construction plans the procurement, agrees with the Department of Finance, and reports to the provincial People's Committee for consideration and decision.

2. Principles for designing, constructing official houses, and warranty, maintenance, and operational management in Vietnam

- official houses are invested and constructed in sync with infrastructure, ensuring criteria on construction density, land use coefficient, and other criteria according to construction planning, standards, and regulations, including:

(1) Villas no more than 4 stories high, with a construction land area from 300 m^2^ to 500 m^2^ (except as specified in clause 1 Article 4 Decision 11/2024/QD-TTg), with garden, fence, and separate entrance, ensuring security and protection systems as prescribed;

(2) Adjoining houses no more than 4 stories high, with a construction land area from 60 m^2^ to 250 m^2^, designed as garden or townhouse types, built attached together, sharing infrastructure system;

(3) Apartments with a usable area from 45 m^2^ to 160 m^2^, designed with enclosed living space, including one or many functional spaces such as: living room, bedrooms, dining room, kitchen, bathroom, balcony or loggia;

(4) Adjoining single-story houses (level IV) with usable area from 24 m^2^ to 60 m^2^, built in single-story style with multiple adjacent houses, each house with enclosed facilities. The minimum usable area is 24 m^2^/house.

- The warranty, maintenance, and operational management of official houses and furnishings are implemented under the construction law, housing law, and other related laws.
