On October 22, 2024, the Government of Vietnam issued Decree 135/2024/ND-CP which prescribes the mechanisms and policies to encourage the development of self-produced, self-consumed rooftop solar energy in Vietnam.

Specifically, Decree 135/2024/ND-CP provides mechanisms and policies to promote the development of self-produced, self-consumed solar energy installed on the rooftops of construction works, including residential houses, public offices, industrial zones, industrial clusters, export processing zones, high-tech zones, economic zones, production facilities, and business establishments, which are invested and constructed according to the law in Vietnam.

According to Article 4 of Decree 135/2024/ND-CP, Principles for the development of self-produced, self-consumed solar power in Vietnam are stipulated as follows:

(1) The development of self-produced, self-consumed rooftop solar energy must ensure transparency, equality among the entities stipulated in Decree 135/2024/ND-CP.

(2) Activities of purchasing and selling any excess electricity (if any) from self-produced, self-consumed rooftop solar energy shall be conducted in accordance with the provisions of Decree 135/2024/ND-CP.

(3) The capacity for developing self-produced, self-consumed rooftop solar energy with connections to the national power grid in each locality must comply with the provisions of this Decree, excluding self-produced, self-consumed rooftop solar energy in island districts and communes with electricity grids not yet connected to the national power grid.

(4) Construction works before installing self-produced, self-consumed rooftop solar energy must ensure compliance with the current legal regulations on investment, construction, land, environment, safety, and fire prevention and fighting. The development of self-produced, self-consumed rooftop solar energy must comply with legal regulations on electric safety, investment, construction, environment, and fire prevention and fighting.

(5) During the investment and construction process of self-produced, self-consumed rooftop solar energy, organizations and individuals must not use imported used solar panels and devices converting direct current to alternating current.

(6) Self-produced, self-consumed rooftop solar energy must be operated safely to ensure the national power system's security equally as with other renewable energy sources (solar energy, wind energy).

Rooftop solar energy is the energy produced from solar panels based on the principle of converting solar energy into electrical energy, through construction structures intended for installation on the rooftops, connected with electrical devices, and directly serves the purpose of electricity generation.

Self-produced, self-consumed rooftop solar energy connected to the national power grid is rooftop solar energy intended to produce and supply electricity to local loads with connections to the national power grid or provide electricity to local loads physically connected to the national power grid.

Self-produced, self-consumed rooftop solar energy not connected to the national power grid is rooftop solar energy intended to produce and supply electricity to local loads not connected to the national power grid and provide electricity to local loads not physically connected to the national power grid.
