Article 3 of Circular 28/2020/TT-BCA stipulates the principles for receiving, classifying, handling, resolving offense denunciation, information about offense, criminal case initiation proposal in Vietnam, including:
- Agencies and individuals with authority must strictly adhere to the principles for receiving, classifying, handling, and resolving offense denunciation, information about offense, criminal case initiation proposal in Vietnam as stipulated in Article 4 of Joint Circular 01/2017/TTLT-BCA-BQP-BTC-BNN&PTNT-VKSNDTC dated December 29, 2017, of the Minister of Public Security, the Minister of National Defense, the Minister of Finance, the Minister of Agriculture and Rural Development, and the Chief Procurator of the Supreme People's Procuracy, which provides for the coordination among competent agencies in implementing certain provisions of the 2015 Criminal Procedure Code on receiving and resolving offense denunciation, information about offense, criminal case initiation proposal in Vietnam .
- Ensuring that all offense denunciation, information about offense, criminal case initiation proposal in Vietnam are promptly received, classified, handled, checked, verified, and resolved within the prescribed timeframe, preventing any criminal acts, individuals, or commercial entities from being missed, and preventing any wrongful charges against innocent individuals or commercial entities.
- The reception and resolution of offense denunciation, information about offense, criminal case initiation proposal in Vietnam must be objective, comprehensive, complete, accurate, prompt, and lawful; any violations of the law in this work must be promptly detected, remedied, and strictly handled.
- The protection of whistleblowers, reporters of crimes, witnesses, victims, and other participants in legal proceedings must be carried out in accordance with Chapter XXXIV of the 2015 Criminal Procedure Code.
