On February 17, 2012, the Government of Vietnam issued Decree 10/2012/ND-CP providing detailed regulations on the implementation of judicial education measures at commune, ward, commune-level town for juvenile offenders in Vietnam.
Principles for imposing educational measures on juvenile offenders in Vietnam (Internet image)
According to Article 4 of Decree 10/2012/ND-CP, the principles of implementing educational measures at the commune, ward, and commune-level town for juvenile offenders in Vietnam are specified as follows:
- The implementation of educational measures at the commune, ward, and commune-level town for juvenile offenders must comply with the provisions of criminal law and criminal sentence enforcement. This ensures the supervision, education, and assistance of the educated person to correct mistakes, develop a sense of legal obedience and community life rules, grow healthily, and become useful members of society.
- Ensure the participation of agencies, organizations, individuals, and families in supervising, educating, and assisting the educated person.
- Any act that infringes on the life, health, honor, dignity, rights, and legitimate interests of the educated person is strictly prohibited.
Furthermore, Article 5 of Decree 10/2012/ND-CP stipulates the funding sources for implementing educational measures at the commune, ward, and commune-level town for juvenile offenders in Vietnam, including:
- State budget according to the current state budget allocation;
- Funds from National Target Programs as prescribed by law;
- Contributions from organizations and individuals as prescribed by law in Vietnam.
Note: The management and use of funds must comply with the provisions of the Law on State Budget and related guiding documents.
