On January 17, 2025, the Central Executive Committee issued Regulation 231-QD/TW regarding the protection of fighting against corruption, wastefulness, and negativity.

Regulation 231-QD/TW specifies the principles, content of protection, responsibilities of party committees, party organizations, leaders of party committees, and party organizations in safeguarding individuals fighting against corruption, wastefulness, and negativity; rights and responsibilities of individuals fighting against these issues; rewards and handling of violations.

The Regulations is applied to party committees, party organizations leading, directing, and executing tasks for prevention and combat against corruption, wastefulness, and negativity; individuals fighting against these issues and their family members (hereinafter referred to as family members); related agencies, organizations, and individuals.

In particular, Article 3 of Regulation 231-QD/TW has specified the principles for protecting individuals fighting against corruption and negativity as follows:

(1) Party committees, party organizations, and leaders must promptly direct and resolve within their authority any information concerning the fight against corruption, wastefulness, and negativity; ensure confidentiality of information and documents as prescribed by law, ensure comprehensive leadership and direction of the Communist Party in the work of protecting individuals fighting against these issues.

(2) Individuals fighting against corruption, wastefulness, negativity, and their family members are to be promptly protected, ensuring safety; their lawful rights and interests are safeguarded.

(3) Proactively prevent, detect, promptly stop, and strictly handle organizations or individuals who threaten, retaliate, or suppress individuals fighting against corruption, wastefulness, negativity, as well as those who exploit the fight against these issues to make false accusations, slander, cause internal disturbances.

Content of protecting individuals fighting against corruption, wastefulness, negativity in Vietnam

According to Article 4 of Regulation 231-QD/TW dated January 17, 2025, the content of protecting individuals fighting against corruption, wastefulness, negativity includes:

- Individuals fighting against corruption, waste, negativity and their family members are protected in terms of confidentiality of their identity and other personal information; life, health, property, honor, dignity, work position, employment; and other lawful rights and interests in accordance with the law.

- Protective measures, authority, procedures, timelines for protection comply with current legal provisions.

Individuals fighting against corruption, wastefulness, negativity are those who report and denounce acts of corruption, wastefulness, and negativity by agencies, organizations, individuals while performing assigned tasks or managing public funds and assets.

Family members of individuals fighting against corruption, wastefulness, negativity who are protected include: Spouse, biological parents, adoptive parents, biological children, adoptive children.

* Rights of Individuals Fighting against Corruption, Wastefulness, Negativity

- Be informed of protective measures; rights and obligations when protective measures are applied.

- Request change, supplement, or termination of protective measures; refuse protective measures.

- Be compensated according to legal provisions on the State's liability for compensation when the competent authority does not implement protective measures or does not do so promptly, causing harm to their life, health, property, or spirit or to their family members.

* Responsibilities of Individuals Fighting against Corruption, Wastefulness, Negativity

- Conform to Communist Party and State laws in processing and resolving complaints, denunciations, and signs of corruption, wastefulness, negativity; do not infringe upon the legitimate and legal rights and interests of organizations and individuals.

- Comply with the requests of the competent authority, organization, or individual in protection, provision of information, documents related to the fight against corruption, wastefulness, negativity; simultaneously, bear responsibility for the accuracy and truthfulness when providing such information and documents.

- Provide evidence (if any) to establish the occurrence of threats, suppression, retaliation, or violations of their rights and interests and those of their family members.

- Adhere to the final settlement conclusions of the competent organization, agency, or unit and other related regulations of the Communist Party and state law.
